Common use of Notice Not Required Clause in Contracts

Notice Not Required. To the extent permitted by law (but without prejudice to any express requirement in a Finance Document): (a) the Mortgagor dispenses with any notice or lapse of time required by law before enforcing this Deed or any Collateral Security or exercising any Power; and (b) without limitation the Mortgagor agrees that: (i) no Mortgagee is required to give notice to any person before enforcement or exercise; (ii) any law (including s57 of the Real Property ▇▇▇ ▇▇▇▇ (NSW) and s111 of the Conveyancing ▇▇▇ ▇▇▇▇ (NSW)) requiring the giving of notice or the compliance with a procedure or the lapse of time before enforcement or exercise is excluded; and (iii) where a law which cannot be excluded requires a period of notice to be given but allows the period to be specified or changed, that period is one day.
