4 1. PeaceHealth has adopted a new system-wide Severance Policy (“Policy”). 5 Under the terms of the Policy, its provisions shall apply to caregivers covered by a collective 7 subject to the right of PeaceHealth to modify or terminate the provisions unilaterally at any time. 8
9 2. Accordingly, the parties agree that caregivers represented by the Association are 10 eligible to receive benefits under the Policy, in accordance with the terms of the Policy as 11 determined by the Employer in its sole discretion, in the same manner and for as long as the 12 Policy applies to all other non-supervisory caregivers of the Employer. 13
14 3. Under the terms of the current Policy, severance benefits are available to an 15 employee in the event of a termination of employment, resulting from position elimination or 16 reduction in force, with no opportunity for recall. Under the terms of the parties’ Agreement, 17 however, nurses who are subject to layoff have recall rights pursuant to Section 14.1. 18 Accordingly, the terms of the parties’ Agreement as written preclude the eligibility of bargaining 19 unit members for severance benefits if their employment is terminated. 20
21 4. The parties wish to avoid the outcome described in Paragraph 3 above.
