Obligation to Finalise Design. The Contractor shall develop and finalise the design and specification of the Works in accordance with the Design and Construction Plan and the Authority may review the Reviewable Design Data in accordance with the Review Procedure and the provisions of this clause.

No Construction prior to Review Subject to clause 14.3.2 the Contractor shall not commence or permit the commencement of the construction of the part or parts of the Works to which any Reviewable Design Data relates until it has submitted the relevant Reviewable Design Data for review and either it is confirmed by the Authority's Representative that the Contractor is entitled to proceed with construction in accordance with the Review Procedure or the Contractor is disputing the status of such Reviewable Design Data pursuant to paragraph 1.3 of Schedule 8 (Review Procedure). If the Contractor commences or permits the commencement of construction before the Authority's Representative provides such approval or during such a dispute and it is subsequently determined that the Contractor was not entitled to proceed with construction in accordance with paragraph 4 of Schedule 8 (Review Procedure), then the Contractor shall forthwith undo, remove from the Site(s) and replace (in a manner complying with this Agreement) any parts of the Works which it has been determined the Contractor was not entitled to construct. Approved RDD With effect from the date on which any item of Reviewable Design Data is or becomes an Approved RDD Item in accordance with the Review Procedure, the Contractor may proceed with the construction of the relevant part or parts of the Works (subject to the need to submit any associated Reviewable Design Data to review) in accordance with that Approved RDD Item. Review of Design Data The Contractor shall allow the Authority's Representative at any time a reasonable opportunity to view any items of Design Data, which shall be made available to the Authority's Representative as soon as reasonably practicable following receipt of any written request from the Authority's Representative.
Obligation to Finalise Design. PPP Co. will develop and finalise the design and specification of the Works and the Authority may review the Reviewable Design Data in accordance with the Review Procedure set out in Schedule 5 (Review Procedure) and the provisions of this Clause 8 (Design Review Procedure).

The change of sponsorship of registration of Registered Names from one registrar to another, according to Part B of the ICANN Policy on Transfer of Registrations between Registrars shall not result in the extension of the term of the registration and Registry Operator may assist in such change of sponsorship.

  • Modification to Article III, Section 2 of the DPA Article III, Section 2 of the DPA (Annual Notification of Rights.) is amended as follows:

  • Application to Court If (i) a claim for indemnification or advancement of Expenses is denied, in whole or in part, (ii) no disposition of such claim is made by the Company within ninety (90) days after the request therefore, (iii) the advancement of Expenses is not timely made pursuant to Section 6 of this Agreement or (iv) payment of indemnification is not made pursuant to Section 5 of this Agreement, the Indemnitee shall have the right to apply to the Delaware Court of Chancery, the court in which the Proceeding is or was pending, or any other court of competent jurisdiction, for the purpose of enforcing the Indemnitee’s right to indemnification (including the advancement of Expenses) pursuant to this Agreement.
