Common use of OFAC Certification Clause in Contracts

OFAC Certification. Tenant represents and warrants that neither they nor the officers and directors controlling Tenant are acting, directly or indirectly, for or on behalf of any person, group, entity, or nation named by the United States Treasury Department as a Specially Designated National and Blocked Person, or for or on behalf of any person, group, entity, or nation designated in Presidential Executive Order 13224 as a person who commits, threatens to commit, or supports terrorism; and that they are not engaged in this transaction directly or indirectly on behalf of, or facilitating this transaction directly or indirectly on behalf of, any such person, group, entity or nation.

Tenant represents and warrants that neither they Tenant nor the officers and directors persons controlling Tenant are acting, acting directly or indirectly, for or on behalf of any person, group, entity, or nation named by the United States Treasury Department as a Specially Designated National and or Blocked Person, or for or on behalf of any person, group, entity, or nation designated in Presidential Executive Order 13224 as a person who commits, threatens to commit, or supports terrorism; and that they are not engaged in this transaction directly or indirectly on behalf of, or facilitating this transaction directly or indirectly on behalf of, any such person, group, entity or nation.

OFAC Certification. Tenant represents and warrants certifies that neither they nor the officers and directors controlling Tenant are (i) it is not acting, directly or indirectly, for or on behalf of any person, group, entity, entity or nation named by any Executive Order or the United States Treasury Department as a terrorist, “Specially Designated National national and Blocked Person”, or for other banned or on behalf of any blocked person, group, entity, nation or nation designated in Presidential Executive Order 13224 as a person who commitstransaction pursuant to any law, threatens to commitorder, rule or supports terrorismregulation that is enforced or administered by the Office of Foreign Assets Control; and that they are (ii) it is not engaged in this transaction transaction, directly or indirectly on behalf of, or instigating or facilitating this transaction transaction, directly or indirectly on behalf of, any such person, group, entity or nation.
