Common use of On Call Allowance Clause in Contracts

On Call Allowance. (a) An employee who agrees to be on call, that is, the employee agrees to make themselves ready and available to return to work at short notice whilst off duty, shall be paid the allowance, for each period of 24 hours or part thereof, set out in Item 17 of Table 2 of Schedule B to this Agreement. (b) An employee who is directed to remain on call during a meal break shall be paid the meal break allowance set out in Item 18 of Table 2 of Schedule B to this Agreement, provided that no allowance shall be paid if, during a period of 24 hours, including such period of on call, the employee is entitled to receive the allowance prescribed in sub-clause 20.5(a). (c) Where an employee on call in accordance with sub-clause 20.5(a), leaves the residential aged care facility and is recalled to duty, she or he shall be reimbursed all reasonable fares and expenses actually incurred. Where in these circumstances the employee elects to use his or her own vehicle the employee shall be paid the per kilometre allowance set out in Item 5 of Table 2 of Schedule B to this Agreement. (d) This subclause shall not apply to a Director of Nursing, Deputy Director of Nursing or Assistant Director of Nursing.

On Call Allowance. (a) An employee who who, at the request of the employer, agrees to be on call, that is, the employee agrees to make themselves ready call and available to return to work at short notice whilst off duty, is rostered on call shall be paid the allowance, for each period of 24 hours or part thereof, set out in Item 17 of Table 2 of Schedule B to this Agreement. An employee on call agrees to make themselves ready and available to return at short notice to work at the employers’ or clients’ premises, whilst off duty. (b) An employee who is directed to remain on call during a meal break shall be paid the meal break allowance set out in Item 18 of Table 2 of Schedule B to this Agreement, provided that no allowance shall be paid if, during a period of 24 hours, including such period of on call, the employee is entitled to receive the allowance prescribed in sub-clause 20.5(a29.5(a). (c) Where an employee on call in accordance with sub-clause 20.5(a29.5(a), leaves the residential aged care facility and is recalled to duty, she or he shall be reimbursed all reasonable fares and expenses actually incurred. Where in these circumstances the employee elects to use his or her own vehicle the employee shall be paid the per kilometre allowance set out in Allowances Item 5 of Table 2 of Schedule B to this Agreement#7. (d) This subclause shall not apply to a Director of Nursing, Deputy Director of Nursing or Nursing, Assistant Director of NursingNursing or CSE 5 employee.

Where in these circumstances the employee elects to use his or her own vehicle the employee shall be paid the per kilometre allowance set out in Item 5 6 of Table 2 5 of Schedule B to this Agreement. (d) This subclause shall not apply to a Director of Nursing, Deputy Director of Nursing or Nursing, Assistant Director of NursingNursing or CSE 5 employee.

(b) An employee who is directed to remain on call during a meal break shall be paid the meal break allowance set out in Item 18 of Table 2 17 of Schedule B B.2 to this Agreement, provided that no allowance shall be paid if, during a period of 24 hours, including such period of on call, the employee is entitled to receive the allowance prescribed in sub-clause 20.5(a)subclause 30.5(a) above. (c) Where an employee on call in accordance in accordance with sub-clause 20.5(a), the above leaves the residential aged care facility their place of work and is recalled to duty, she or he shall be reimbursed all reasonable fares and expenses actually incurred. Where in these circumstances the employee elects to use his or her own vehicle the employee shall be paid the per kilometre allowance set out in Item 5 of Table 2 of Schedule B B.2 to this Agreement. (d) This subclause shall not apply to a Director of Nursing, Deputy Director of Nursing Nursing, or Assistant Director of NursingGrade 5 Coordinators.

(d) This subclause shall not apply to a Director of Nursing, Deputy Director of Nursing or Nursing, Assistant Director of NursingNursing or CSE 5 employee.

(c) Where an employee on call in accordance with sub-clause 20.5(a21.4(a), leaves the residential aged care facility and is recalled to duty, she or he shall be reimbursed all reasonable fares and expenses actually incurred. Where in these circumstances the employee elects to use his or her own vehicle the employee shall be paid the per kilometre allowance set out in Item 5 6 of Table 2 5 of Schedule B to this Agreement. (d) This subclause shall not apply to a Director of Nursing, Deputy Director of Nursing or Nursing, Assistant Director of NursingNursing or CSE 5 employee.
