Common use of On-Call Service Clause in Contracts

On-Call Service. An employee who is scheduled to remain available to conduct the work of the Employer via the telephone or in person during the on-call period shall be compensated as set out below: a) One hour, at the employee’s straight time hourly rate, will be paid for each on-call period; and b) In the event the employee is required to respond to calls, compensation will be at the rate of one and a one-half (1 ½) times for all hours worked. On Sundays and paid holidays, compensation will be at the rate of double time (2x). In the event an employee spends any time responding to calls for the Employer during the on-call period, the Employee shall be paid a minimum of one-half (½) hour at the applicable rate. The Employer will seek to maintain a roster of qualified staff who volunteer to participate in the on-call service. In the event there are insufficient volunteers, the Employer will schedule employees who have completed their probationary period, on a seniority basis starting at the bottom of the seniority list. The employee shall also be reimbursed for any travel costs at the regular mileage rate.
