Common use of Operation Date Clause in Contracts

Operation Date. The Operation Date may occur only after the Facility has achieved all of the following: a) Completed all Conditions to Acceptance of Energy as specified in Article IV. b) Commission approval of this Agreement has been received. c) Seller has demonstrated to Idaho Power's satisfaction that the Facility is complete and able to provide energy in a consistent, reliable and safe manner and has requested an Operation Date in written form. d) Seller has received written confirmation from Idaho Power of the Operation Date. This confirmation will not be unreasonably withheld by Idaho Power.
