Operation of School. The Sponsor shall assume operation of the school throughout the pendency of the hearing unless the continued operation of the School would materially threaten the health, safety, or welfare of the students.
Operation of School. 2.1 Purpose
Operation of School a) Unless the School has already ceased operations, the Sponsor shall assume operation of the school throughout the pendency of the hearing under §§1002.33(8)(b)&(c), F.S., unless the continued operation of the School would materially threaten the health, safety, or welfare of the students. Failure by the Sponsor to assume and continue operation of the School shall result in the awarding of reasonable costs and attorney’s fees to the School if the School prevails on appeal.
b) The feasibility of continuing the School’s operations is a matter within the sole judgment of the Sponsor.
c) The Sponsor shall hold and conserve all School property and assets, including cash and investments, in trust until the School has exhausted all appellate rights pursuant to Section 1002.33(8), F.S. The Sponsor shall only disburse School funds in order to pay the normal expenses of the School as they accrue in the ordinary course of business. Normal expenses shall include, but not be limited to, the payment of employee salaries and benefits.

Operation of School. The CBEd shall use the Premises leased hereby for the operation of a public school, known as the “Westlawn School” and for purposes related to such operation.

5.1.2 TFS shall comply with all federal and state laws and regulations and all requirements imposed by BESE rules, policies and regulations, including those concerning the education of children with exceptionalities, including the requirements of the Individuals with Disabilities Act (20 U.S.C. 1401 et seq.), Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794), the Americans with Disabilities Act (42 U.S.C. 12101 et seq.).
5.1.3 RSD agrees to transfer a single lump sum payment in the amount of the fund balance from the previously operated charter school, once that amount is determined, for the purpose of providing the funds for the continued education of the students from the former charter school.
5.1.4 TFS shall not enter into an agreement with a management organization without prior written approval from the representatives of the Office of School Choice, Louisiana Department of Education.
5.1.5 TFS shall serve grades K-8 for the school years under the duration of this agreement as outlined in section 5.
1.1. TFS may enroll up to, but shall not exceed the enrollment maximums specified in Appendix A, specifically incorporated herein.
5.1.6 TFS, as contractor for the RSD, agrees to follow all laws and regulations applicable to public schools under the jurisdiction of the Recovery School District for the operation of the school. In situations where TFS is unsure or unclear how laws or regulations apply to TFS or the school, TFS agrees to consult the representatives of the Office of School Choice, Louisiana Department of Education prior to action, as practicable.
5.1.7 Failure to timely fulfill any material term of the Pre-Opening Procedures, as defined by the RSD, shall be considered a material violation of conditions, standards, or procedures provided for in the approved Agreement and may be grounds for termination pursuant to 6.4 of this Agreement. Nothwithstanding the immediately foregoing sentence, the RSD may waive or modify the restrictions contained therein upon good cause shown.
Operation of School. The Sponsor shall assume operation of the school and may close it or operate it during the pendency of an appeal.
