Optional Mediation (External). Prior to submitting a grievance to arbitration, the Parties may mutually agree to non-binding mediation: (i) After receipt of the decision from the Employer under Step 2 above, either Party may request that a Mediator be appointed to meet with the parties, to investigate and define the issues in dispute and facilitate a resolution. (ii) The Mediator shall be appointed by mutual agreement between the Parties. (iii) During the proceedings, the Parties shall fully disclose all materials and information relevant to the issue in dispute. (iv) The purpose of the Mediator’s involvement in the grievance process is to assist the parties in reaching a resolution of the dispute, and anything said, proposed, generated or prepared for the purpose of trying to achieve a settlement is to be considered privileged and will not be used for any other purpose. (v) The expenses of the Mediator shall be equally borne by both parties. (vi) The grievance may be resolved by mutual agreement between the parties. The Parties may request that the Mediator issue a report including non-binding recommendations.

  • Mandatory Mediation Prior to and as a condition of either Party’s filing suit in state or federal court, the Parties shall engage in a mediated settlement conference in accordance with the North Carolina Superior Court Rules Implementing Statewide Mediation. The Parties shall mediate in good faith until settlement is reached or an impasse is declared by the mediator.

  • Termination of Mediation The mediation shall be terminated: 1) By the execution of a Settlement Agreement by the Parties; 2) By a written declaration of the mediator to the effect that further efforts at mediation are no longer worthwhile; or 3) By a written declaration of a Party or Parties to the effect that the mediation proceedings are terminated.

  • Office of Inspector General Investigative Findings Expert Review In accordance with Senate Bill 799, Acts 2021, 87th Leg., R.S., if Texas Government Code, Section 531.102(m-1)(2) (eff. Apr. 1, 2025, Section 544.0106, pursuant to House Bill 4611, Acts 2023, 88th Leg., R.S.) is applicable to this Contract, Contractor affirms that it possesses the necessary occupational licenses and experience.

  • Voluntary Mediation a) The central parties may, on mutual agreement, request the assistance of a mediator. b) Where the central parties have agreed to mediation, the cost shall be shared equally between the central parties. c) Timelines shall be suspended for the period of mediation.
