Owner-Requested Changes. If the Owner requests changes in the Contract Documents that would materially affect the completion of the Work by lengthening the critical path of the Overall Project Schedule, the Executive Administrator shall determine the appropriate number of days and thereby extend the Material Completion and Occupancy Date. The Design-Builder expressly agrees that the Design-Builder’s sole monetary remedy for such extensions of Contract Time shall be no greater than the actual direct costs incurred by Design-Builder. Actual compensation for such Compensable Delay shall be mutually agreed upon by Design-Builder and Owner.
