When an employee works in a higher classification during all hours 25 worked in an FLSA work week or longer period of time, the employee will be paid the out of class 26 rate for all hours in pay status on days in which he or she was on leave for less than half (½) a 27 shift. 28 b. An employee using leave while working out of class will be paid at 29 his or her regular rate of pay for all hours in pay status on days in which he or she worked half (½) 30 or less of his or her scheduled hours.
