Parallel Operations. For no additional cost, the DOD agency shall have the ability to run Publisher’s software on parallel systems for up to 180 days, or a longer mutually agreed upon timeframe, for system migrations ,testing, and/or hardware refreshes. The DOD will ensure the duplicate Instances required duringthe Parallel Operation period are uninstalled and deleted once the parallel operation is no longer required. The DOD will only request the ability to runthe same number of license Instances that are currently owned by the DOD.
Parallel Operations. If the Company establishes any new airline or acquires a controlling interest in any 4 carrier, which operates jet aircraft, and mainline pilots on the American Airlines, Inc.
Parallel Operations. 1. The Company shall not directly or through an Affiliate:
a. Establish any new airline or acquire a Controlling interest in any carrier, which operates jet equipment or jet replacement aircraft with a maximum FAA certificated capacity of sixty (60) seats or more for the purpose of avoiding the terms of this Agreement.
b. Establish any new repair station or acquire a controlling interest in any entity which repairs or maintains aircraft within the United States, except an air carrier, unless employees covered by this Agreement perform the entity’s repair or maintenance work.
2. The Company shall not allow its code to be placed on any domestic flight operated by a commuter feeder airline, which is Controlled by the Company or an Affiliate, if the flight utilizes jet equipment or jet replacement aircraft with a maximum FAA certificated capacity of sixty (60) seats or more.

If the Company, directly or through an Affiliate, establishes any new airline or acquires a Controlling interest in any carrier, which operates jet equipment or jet replacement aircraft, and mainline pilots on the United Airlines pilot seniority list perform revenue flying utilizing such equipment, then all aircraft maintenance work on such aircraft will be performed by Technicians on the United Airlines technician master seniority list in accordance with the provision of Article 1.
b. Establish any new repair station or acquire a controlling interest in any entity which repairs or maintains aircraft within the United States, except an air carrier, unless employees covered by this Agreement perform the entity's repair or maintenance work.
2. A “parallel system” is a non-production environment which DoD is preparing to become a production environment within 180 days, or longer mutually agreed upon timeframe. Tanium shall not withhold consent for such an extension to the extent parallel operations are necessary to accomplish the migration, testing or hardware refresh. The DOD will ensure the duplicate Instances required duringthe Parallel Operation period are uninstalled and deleted once the parallel operation is no longer required. The DOD will only request the ability to runthe same number of license Instances that are currently owned by the DOD. If additional licenses are required than the quantity owned by the DOD agency, the DOD will acquire the necessary licenses.

6 1. If the Company establishes any new airline or acquires a controlling interest 7 in any carrier, which operates jet aircraft, and mainline pilots on the 8 American Airlines, Inc. pilot seniority list perform revenue flying utilizing 9 such aircraft, then all covered fleet service work on such aircraft shall be 10 performed by employees covered by this Agreement list in accordance with 11 the provisions of this Article. 12

If the Company allows its code to be placed on any flight and the flight 14 utilizes jet aircraft and mainline pilots on the American Airlines, Inc. pilot 15 seniority list perform revenue flying utilizing such aircraft, then all covered 16 fleet service work on such aircraft shall be performed by employees covered 17 by this Agreement in accordance with the provisions of this Article. 18 19 The time limit for grievances filed under this Article involving contracting out of work or 20 insourcing new stations will be thirty (30) calendar days from the date on which the dispute 21 arises or which the Union reasonably should have discovered the claimed violation.
