Common use of Parties to resolve Dispute Clause in Contracts

Parties to resolve Dispute. (a) During the 10 Business Days after a notice is given under clause 15.2 (or longer period if the parties to the Dispute agree in writing) (Period), each party to the Dispute must use its reasonable efforts to resolve the Dispute or to agree that the Dispute will be submitted to mediation. (b) If the parties cannot resolve the Dispute or agree to mediation within that Period, or if there is a submission to mediation, but there is no resolution within 20 Business Days of the submission, or such extended time as the parties may agree in writing before the expiration of the 20 Business Days, either party may commence legal proceedings.

(b) If the parties cannot resolve the Dispute or agree to mediation within that Period, or if there is a submission to mediation, but there is no resolution within 20 Business Days of the submission, or such extended time as the parties may agree in writing before the expiration of the 20 Business Days, either party may commence legal proceedings.

(b) Dispute. If the parties cannot resolve the Dispute or agree to mediation within that Periodperiod, they must refer the Dispute to an independent mediator if one of them requests. If the parties to the Dispute cannot agree on an independent mediator within 5 Business Days after a request under clause 36.3, or if there they have agreed and a resolution is not reached within a submission to mediation, but there is no resolution within further 20 Business Days of the submission, (or other such extended time period as the parties may agree to in writing before the expiration of the 20 Business Dayswriting), either party may commence legal proceedings.
