By providing us with names and telephone numbers, email addresses, and/or bank account information of Receivers to whom you wish to direct payments, you authorize us to follow the Payment Instructions that we receive through the Service. When we receive a Payment Instruction from you, you authorize us to debit your Eligible Transaction Account and remit funds on your behalf. You also authorize us to credit your Eligible Transaction Account for the receipt of payments, including but not limited to those payments returned to us from Receivers to whom you sent payment(s) or cancelled and returned to you because the processing of the payment transaction could not be completed. You agree that we will not be liable in any way for any payments that you may receive, regardless of whether you authorized the Sender to send them to you. We will use reasonable efforts to complete all your payment transactions properly. However, we shall incur no liability if we are unable to complete any transaction because of the existence of any one or more of the following circumstances: If, through no fault of ours, the Eligible Transaction Account does not contain sufficient funds to complete the payment transaction or the payment transaction would exceed the credit limit of your overdraft account; The Service is not working properly and you know or have been advised by us about the malfunction before you execute the payment transaction; The payment is refused as described in Section 20 below; You have not provided us with the correct information, including but not limited to the correct Payment Instructions or Eligible Transaction Account information, or the correct name and address or mobile phone number of the Receiver to whom you are initiating a payment transaction; and/or, Circumstances beyond our control (such as, but not limited to, fire, flood, network or system down time, issues with the financial institution, or interference from an outside force) prevent the proper execution of the payment transaction and we have taken reasonable precautions to avoid those circumstances. It is the responsibility of the Sender and the Receiver to ensure the accuracy of any information that they enter into the Service (including but not limited to the Payment Instructions and name, telephone number and/or email address that the Sender enters for the Receiver to whom you are sending the payment transaction), and for informing us as soon as possible if they become aware that this information is inaccurate. Neither the Sender nor Receiver may use a P.O. Box as a postal address. We will make a reasonable effort to stop or recover a payment transaction made to the wrong person or entity once informed, but we do not guarantee such stoppage or recovery and will bear no responsibility or liability for damages resulting from incorrect information entered by the Sender or Receiver. In this End Users Agreement, the words “I,” “me,” “my,” “us” and “our” mean the (consumer or business) that applied for and/or uses any of the Remote Deposit Capture Services (the “Services”) described in this End Users Agreement. The words “your Credit Union,” “our Credit Union,” and “the Credit Union” mean Farmers Insurance Federal Credit Union. My Application for use of the services, your notification of approval of my application, and my Credit Union (Account Agreement and Disclosures) are hereby incorporated into and made a part of this End Users Agreement. It is the responsibility Provided none of the Sender foregoing exceptions are applicable, if the Service causes an incorrect amount of funds to be removed from your Payment Account or causes funds from your Payment Account to be directed to a Payee which does not comply with your Payment Instructions, the Service shall be responsible for returning the improperly transferred funds to your Payment Account, and for directing to the Receiver proper Payee any previously misdirected transactions, and, if applicable, for any late payment related charges. When you initiate electronic payments from your account through the ACH Network you act as the Originator and we act as the ODFI. As Originator, you authorize us as the ODFI to originate the Entries on your behalf to the Receivers’ accounts. By submitting Entries and by using the ACH Network you demonstrate your agreement to be bound by NACHA Rules as now in effect or as may be amended from time to time. You acknowledge that you have a copy of the NACHA Rules or that you have access to a copy of the NACHA Rules. As the Originator is it your responsibility to ensure the accuracy that Entries and originations of any information that they enter into the Service (ACH transactions comply with U.S. Law including but not limited to the Payment Instructions and name, telephone number and/or email address that the Sender enters for the Receiver to whom you are sending the payment transaction), and for informing us as soon as possible if they become aware that this information is inaccurate. Neither the Sender nor Receiver may use a P.O. Box as a postal address. We will make a reasonable effort to stop or recover a payment transaction made to the wrong person or entity once informed, but we do not guarantee such stoppage or recovery and will bear no responsibility or liability for damages resulting from incorrect information entered sanctions enforced by the Sender or ReceiverOffice of Foreign Assets Control (“OFAC”). In this End Users AgreementYou represent and warrant to us that:
a. Each person shown as the receiver on the an entry received by us from you has authorized the initiation of such entry and the crediting of its account in the amount and on the date on such entry,
b. Such authorization is operative at the time of transmittal of entries by us,
c. Entries you transmit to us are limited to credit entries to accounts held by consumer receivers only and are subject to limits we establish and change from time to time without prior notice to you, and
d. You have received notice of the rule regarding provisional payment and the fact that if a settlement is not received, the words “I,” “me,” “my,” “us” RDFI is entitled to a refund from the intended ACH recipient and “our” mean you shall not be deemed to have paid the (consumer or business) that applied for and/or uses any intended ACH recipient the amount of the Remote Deposit Capture Services (the “Services”) described in this End Users Agreement. The words “your Credit Union,” “our Credit Union,” and “the Credit Union” mean Farmers Insurance Federal Credit Union. My Application for use of the services, your notification of approval of my application, and my Credit Union (Account Agreement and Disclosures) are hereby incorporated into and made a part of this End Users Agreement. Payment Authorization and Payment Remittance. a. By providing us with names and and/or telephone numbers, numbers and/or email addresses, addresses and/or bank account information of Receivers to whom you wish to direct payments, you authorize us to follow the Payment Instructions that we receive through the Service. .
b. When we receive a Payment Instruction from you, you authorize us to debit your Eligible sending Transaction Account and remit funds on your behalf. You also authorize us to credit your Eligible receiving Transaction Account for the receipt of payments, including but not limited to those payments returned to us from Receivers to whom you sent payment(spayments(s) or cancelled and returned to you because the processing of the payment transaction could not be completed. You acknowledge and agree that if your Payment Instructions identify an account by name and account number, the relevant financial institution may execute those Payment Instructions by reference to the account number only, even if such account number does not correspond to the account name. You further acknowledge and agree that financial institutions holding the account may choose to not investigate discrepancies between account names and account numbers.
c. Once registered, you as a Receiver authorize us to credit your Transaction Account for payments remitted to you on behalf of a Sender without further approval from you. You agree that we will not be liable in any way for any payments that you may receive, regardless of whether you authorized the Sender to send them to you. If you do not register, then funds will not be transferred to you from the Sender’s Transaction Account, and the payment transaction will be cancelled.
d. We will use reasonable efforts to complete make all your payment transactions payments properly. However, we shall incur no liability if we are unable to complete any transaction payments initiated by you because of the existence of any one or more of the following circumstances: :
1. If, through no fault of ours, the Eligible Transaction Account does not contain sufficient funds to complete the payment transaction or the payment transaction would exceed the credit limit of your overdraft account; .
2. The Service is not working properly and you know or have been advised by us about the malfunction before you execute the payment transaction; ;
3. The payment is refused as described in Section 20 section 7 below; .
4. You have not provided us with the correct information, including but not limited to the correct Payment Instructions instructions or Eligible Transaction Account information, or the correct name and email address or mobile phone number of the Receiver to whom you are initiating sending a payment transactionpayment; and/or,
5. Circumstances beyond our control (such as, but not limited to, fire, flood, network or system down time, issues with the financial institution, or interference from an outside force) prevent the proper execution of the payment transaction and we have taken reasonable precautions to avoid those circumstances. .

My Application for use of the services, your notification of approval of my application, and my Credit Union (Account Agreement and Disclosures) are hereby incorporated into and made a part of this End Users Agreement. By providing us the Service with names and telephone numbers, email addresses, and/or bank account information of Receivers Billers to whom you wish to direct payments, you authorize us the Service to follow the Payment Instructions that we receive it receives through the ServiceSite. In order to process payments more efficiently and effectively, the Service may edit or alter payment data or data formats in accordance with ▇▇▇▇▇▇ directives. When we receive the Service receives a Payment Instruction from youInstruction, you authorize us the Service to debit your Eligible Transaction Account and remit funds on your behalfbehalf so that the funds arrive as close as reasonably possible to the Scheduled Payment Date designated by you. You agree that we The Service will not be liable in any way for any payments that you may receive, regardless of whether you authorized the Sender attempt to send them to you. However, we the Service shall incur no liability and any Service Guarantee (as described in Section 3 of the Bill Payment Terms) shall be void if we are the Service is unable to complete any transaction payments initiated by you because of the existence of any one or more of the following circumstances: :

b) The Service payment processing center is not working properly and you know or have been advised by us the Service about the malfunction before you execute the payment transaction; The payment is refused as described in Section 20 below; ;
c) You have not provided us the Service with the correct information, including but not limited to the correct Payment Instructions or Eligible Transaction Account information, or the correct name and address name, address, phone number, or mobile phone number account information for the ▇▇▇▇▇▇; and/or,
d) Circumstances beyond control of the Receiver to whom you are initiating a payment transaction; and/or, Circumstances beyond our control Service (such as, but not limited to, fire, flood, network or system down time, issues with the financial institution, or interference from an outside force) prevent the proper execution of the payment transaction and we have the Service has taken reasonable precautions to avoid those circumstances. Except for the foregoing, if the Service causes an incorrect amount of funds to be removed from an outside forceyour Pay From Account or causes funds from your Pay From Account to be directed to a Payee which does not comply with your Payment Instructions, the Service shall be responsible, as applicable, to: (a) prevent return improperly transferred funds to your Pay From Account, (b) redirect misdirected transactions to the proper execution Payee, and (c) pay the Payee or reimburse your payment of the Payee for late payment transaction and we have taken reasonable precautions to avoid those circumstances. It is the responsibility of the Sender and the Receiver to ensure the accuracy of any information that they enter into the Service (including but not limited to the Payment Instructions and name, telephone number and/or email address that the Sender enters for the Receiver to whom you are sending the payment transaction), and for informing us as soon as possible if they become aware that this information is inaccurate. iii. The payment is refused;

You have not provided us with the correct information, including but not limited to the correct Payment Instructions or business) that applied for and/or uses any Eligible Transaction Account information, or the correct name and address or mobile phone number of the Remote Deposit Capture Services Receiver to whom you are initiating a payment transaction; and/or,
v. Circumstances beyond our control (such as, but not limited to, fire, flood, network or system down time, issues with the “Services”financial institution, or interference from an outside force) described in this End Users Agreement. The words “your Credit Union,” “our Credit Union,” and “prevent the Credit Union” mean Farmers Insurance Federal Credit Union. My Application for use proper execution of the services, your notification of approval of my application, payment transaction and my Credit Union (Account Agreement and Disclosures) are hereby incorporated into and made a part of this End Users Agreement. d. Payment Authorization and Payment Remittance. a. By providing us with names and and/or telephone numbers, numbers and/or email addresses, addresses and/or bank account information of Receivers to whom you wish to direct payments, you authorize us to follow the Payment Instructions that we receive through the Service. .
b. When we receive a Payment Instruction from you, you authorize us to debit your Eligible sending Transaction Account and remit funds on your behalf. You also authorize us to credit your Eligible receiving Transaction Account for the receipt of payments, including but not limited to those payments returned to us from Receivers to whom you sent payment(spayments(s) or cancelled and returned to you because the processing of the payment transaction could not be completed. You acknowledge and agree that if your Payment Instructions identify an account by name and account number, the relevant financial institution may execute those Payment Instructions by reference to the account number only, even if such account number does not correspond to the account name. You further acknowledge and agree that financial institutions holding the account may choose to not investigate discrepancies between account names and account numbers.
c. Once registered, you as a Receiver authorize us to credit your Transaction Account for payments remitted to you on behalf of a Sender without further approval from you. You agree that we will not be liable in any way for any payments that you may receive, regardless of whether you authorized the Sender to send them to you. If you do not register,
d. We will use reasonable efforts to complete make all your payment transactions payments properly. However, we shall incur no liability if we are unable to complete any transaction payments initiated by you because of the existence of any one or more of the following circumstances: :
1. If, through no fault of ours, the Eligible Transaction Account does not contain sufficient funds to complete the payment transaction or the payment transaction would exceed the credit limit of your overdraft account; .
2. The Service is not working properly and you know or have been advised by us about the malfunction before you execute the payment transaction; ;
3. The payment is refused as described in Section 20 section 7 below; .
4. You have not provided us with the correct information, including but not limited to the correct Payment Instructions instructions or Eligible Transaction Account information, or the correct name and email address or mobile phone number of the Receiver to whom you are initiating sending a payment transactionpayment; and/or,
5. Circumstances beyond our control (such as, but not limited to, fire, flood, network or system down time, issues with the financial institution, or interference from an outside force) prevent the proper execution of the payment transaction and we have taken reasonable precautions to avoid those circumstances. .
e. Circumstances beyond our control (such as, but not limited to, fire, flood, network or system down time, issues with the “Services”financial institution, or interference from an outside force) described in this End Users Agreement. The words “your Credit Union,” “our Credit Union,” and “prevent the Credit Union” mean Farmers Insurance Federal Credit Union. Payment Authorization and Payment Remittance. By providing us with the names and telephone numbers, email addresses, and/or bank account information of Receivers Payees to whom you wish to direct payments, you authorize us to follow the Payment Instructions that we receive through the Service▇▇▇▇ Payment. In order to process payments more efficiently and effectively, we may edit or alter payment data or data formats in accordance with Payee directives. When we receive a ▇▇▇▇ Payment Instruction from youreceives Payment Instructions, you authorize us to debit your Eligible Transaction ▇▇▇▇ Payment Account and remit funds on your behalfbehalf so that the funds arrive as close as reasonably possible to the Scheduled Payment Date. You also authorize us to credit your Eligible Transaction ▇▇▇▇ Payment Account for the receipt of payments, including but not limited to those payments returned to us from Receivers to whom you sent payment(s) by the U.S. Postal Service or cancelled and returned Payee, or payments remitted to you because the processing on behalf of the payment transaction could not be completed. You agree that we will not be liable in any way for any payments that you may receive, regardless another authorized user of whether you authorized the Sender to send them to you▇▇▇▇ Payment. We will use reasonable our best efforts to complete make all your payment transactions payments properly. However, we the Service shall incur no liability and any Service Guarantee shall be void if we are the Service is unable to complete any transaction payments initiated by you because of the existence of any one or more of the following circumstances: • If, through no fault of ours, the Eligible Transaction your ▇▇▇▇ Payment Account does not contain sufficient funds to complete the payment transaction or the payment transaction would exceed the credit limit of your overdraft accountoverdraftaccount; • The Service payment processing center is not working properly and you know or have been advised by us about the malfunction before you execute the payment transaction; The payment is refused as described in Section 20 below; • You have not provided us with the correct information, including but not limited to the correct ▇▇▇▇ Payment Instructions or Eligible Transaction Account information, or the correct name and address name, address, phone number, or mobile phone number of account information for the Receiver to whom you are initiating a payment transactionPayee; and/or, • Circumstances beyond our control (such as, but not limited to, e.g. fire, flood, network or system down time, issues with the financial institution, or interference from an outside force) prevent the proper execution of the payment transaction and we have taken reasonable precautions to avoid those circumstances. It is the responsibility of the Sender and the Receiver to ensure the accuracy of any information that they enter into the Service (including but not limited to the Payment Instructions and name, telephone number and/or email address that the Sender enters for the Receiver to whom you are sending the payment transaction), and for informing us as soon as possible if they become aware that this information is inaccurate. Neither the Sender nor Receiver may use a P.O. Box as a postal address. We will make a reasonable effort to stop or recover a payment transaction made to the wrong person or entity once informed, but we do not guarantee such stoppage or recovery and will bear no responsibility or liability for damages resulting from incorrect information entered by the Sender or Receiver. In this End Users Agreement, the words “I,” “me,” “my,” “us” and “our” mean the (consumer or business) that applied for and/or uses any of the Remote Deposit Capture Services (the “Services”) described in this End Users Agreement. The words “your Credit Union,” “our Credit Union,” and “the Credit Union” mean Farmers Insurance Federal Credit Union. My Application for use of the services, your notification of approval of my application, and my Credit Union (Account Agreement and Disclosures) are hereby incorporated into and made a part of this End Users Agreement. We will use reasonable efforts to complete all your payment transactions properly. However, we shall incur no liability if we are unable to complete any transaction payments initiated by you because of the existence of any one or more of the following circumstances: :
i. If, through no fault of ours, the Eligible Transaction Account your account does not contain sufficient funds to complete the payment transaction or the payment transaction would exceed the credit limit of your overdraft account; transaction;

Payment Authorization and Payment Remittance. 1. By providing us with names and telephone numbers, email e-mail addresses, and/or bank account information of Receivers to whom you wish to direct payments, you authorize us to follow the Payment Instructions that we receive through the Popmoney Service.
2. When we receive a Payment Instruction from you, you authorize us to debit your Eligible Transaction Account and remit funds on your behalf. You also authorize us to credit your Eligible Transaction Account for the receipt of payments, including but not limited to those payments returned to us from Receivers to whom you sent payment(s) or cancelled and returned to you because the processing of the payment transaction could not be completed.
3. You acknowledge and agree that if your Payment Instructions identify an account by name and account number, the relevant financial institution may execute those Payment Instructions by reference to the account number only, even if such account number does not correspond to the account name. You further acknowledge and agree that financial institutions holding the account may choose to not investigate discrepancies between account names and account numbers and that we have no responsibility to investigate discrepancies between account names and account numbers.
4. You agree that we will not be liable in any way for any payments that you may receive, regardless of whether you authorized the Sender to send them to you. We will use reasonable efforts to complete all your payment transactions properly.
