Payment by Department. Payment of invoices by the Department shall not constitute acceptance or approval of Contractor’s performance nor foreclose the right of the Department and HHSC to recover excessive or illegal payments. All invoices and Contractor’s performance are subject to review and audit by the Department.

Payment by Department. In consideration for the terms and conditions described herein, including the complete release of all claims as described below and the dismissal of the Lawsuit and Related Lawsuits with prejudice, the Department shall pay the Gross Settlement Amount of $13,000,000.00, which shall be distributed as discussed in this Agreement. a. With fourteen (14) days of the date of Preliminary Approval, Class Counsel, the Claims Administrator, and/or the QSF Administrator shall register the QSF as a vendor on the Statewide Integrated Government Management Application System (SIGMA). Payment of the Gross Settlement Amount is contingent upon registration with SIGMA. b. The Gross Settlement Amount shall be deposited into a QSF, established by Class Counsel with the Department’s approval, within thirty (30) days of the date of Preliminary Approval. The payment will be made by electronic funds transfer (EFT) through SIGMA. c. The Department and Class Counsel shall provide to the QSF Administrator the documentation necessary to facilitate obtaining QSF status.

  • Fire Department Service Charge We will pay up to $500 for your liability assumed by contract or agreement for fire department charges incurred when the fire department is called to save or protect covered property from a Peril Insured Against. We do not cover fire department service charges if the property is located within the limits of the city, municipality or protection district furnishing the fire department response. This coverage is additional insurance. No deductible applies to this coverage.
