PAYMENT OF EMD Clause Samples

The 'Payment of EMD' clause requires bidders or participants to submit an Earnest Money Deposit (EMD) as part of the bidding or tendering process. Typically, this deposit is a specified sum of money paid upfront to demonstrate the bidder's seriousness and commitment to the process, and it may be forfeited if the bidder withdraws or fails to fulfill certain obligations. The core function of this clause is to deter frivolous bids and ensure that only genuine, committed parties participate, thereby protecting the interests of the entity inviting the bids.
