PEG Capacity Clause Samples
PEG Capacity. The Grantee shall provide capacity for the Village’s noncommercial Public, Educational and Governmental Access (“PEG”) Programming through one Channel (the “Channel”) on the Grantee’s Cable System. Unless otherwise agreed to by the Village and the Grantee to the extent required by applicable law, the Channel may be carried on the Grantee’s basic digital service tier. The Village’s PEG Access Programming shall be provided consistent with Section 611 of the Cable Act, as amended from time to time.
PEG Capacity. The Grantee shall provide capacity for the City's noncommercial Public, Educational and Governmental Access ("PEG") Programming through Grantees Cable System consistent with the requirements set forth herein. As of the Effective Date of this Agreement, the City uti1izes (2) channel(s), which the City can expand back to its original 3 channels upon notice. Unless otherwise agreed to by the City and the Grantee to the extent required by applicable law, the Channel shall be carried on the Grantee's basic service tier. The City's PEG Access Programming shall be provided consistent with Section 611 of the Cable Act, as amended from time to time.

As of the Effective Date of this Agreement, the City utilizes no PEG Channel. The Grantee shall provide the City with one (1) PEG Channel upon 180 days prior written request of the City. The Grantee agrees to submit a cost estimate to activate the PEG Access Channel within a reasonable period of time after the City’s request. The City may accept or decline the Grantee’s cost estimate in the City’s sole discretion. After an agreement to reimburse the Grantee the costs of activating the PEG Access Channel, the Grantee shall proceed to active the PEG Access Channel within the number of days set forth above. If no agreement is reached between the Grantee and City, the Grantee is not obligated to activate the PEG Access Channel. Unless otherwise agreed to by the City and the Grantee to the extent required by applicable law, the PEG Access Channel shall be carried on the Grantee’s basic digital service tier. The City’s PEG Access Programming shall be provided consistent with Section 611 of the Cable Act, as amended from time to time.

As of the Effective Date of this Agreement, the City does not utilize a PEG channel; however, the City may request, and Grantee shall provide, a PEG channel upon one hundred eighty (180) days advance written notice by the City. The Grantee shall provide capacity for the City's noncommercial public, educational and governmental access ("PEG") programming through one Channel (the "Channel") on the Grantee's Cable System. Unless otherwise agreed to by the City and the Grantee to the extent required by applicable law, the Channel may be carried on the Grantee's basic digital service tier. The City's PEG programming shall be provided consistent with Section 611 of the Cable Act, as amended from time to time.

As of the Effective Date of this Agreement, the City utilizes two Channels which are time shared with the Town of Normal. Unless otherwise agreed to by the City and the Grantee to the extent required by applicable law, the Channel(s) may be carried on the Grantee’s basic digital service tier. The City’s PEG programming shall be provided consistent with Section 611 of the Cable Act, as amended from time to time.

8.1.1 As of the Effective Date of this Agreement, the Village utilizes four (4) PEG Channels and Grantee shall continue to provide four (4) PEG Channels for the term of this Agreement. The Grantee shall provide the Village’s entire PEG Access programming on the Grantee’s Basic Service Tier.
