The Parties understand and agree that full and complete payment for Work performed for a single Work Order Package or in shall not exceed the sum of THREE MILLION DOLLARS ($3,000,000.00), excluding change orders but inclusive of hiring incentives, if any. Design- Builder’s performance of the Work shall be compensated either on a lump sum basis in an amount not to exceed the amount set forth in the applicable Work Order Package or Request or on a Unit Price, Crew Hour Rate or Time and Equipment basis as set forth in the Work Order Package.
