Common use of Performance Agreement Clause in Contracts

Performance Agreement. 4.1 Unless otherwise determined by the Chief Executive (or Chief Executive’s delegate), the Officer must: (a) enter into the first Performance Agreement after initial appointment to the Position within 3 months after the Commencement Date; and (b) thereafter, enter into a Performance Agreement within 3 months after the start of each financial year within the term of this Contract. 4.2 The Officer’s performance against the Performance Agreement will be assessed from time to time, as determined by the Chief Executive. 4.3 The Officer’s performance, as assessed in accordance with clause 4.2, will be a significant determining factor in the continued employment of the Officer under this Contract.
