Common use of Performance Data Clause in Contracts

Performance Data. The Supplier retains all right, title and interest in data and data elements collected by the Services which, as applicable, pertains to the usage and performance of the Services ("Performance Data"). Without limiting the foregoing, the Supplier may collect and use Performance Data to provide to its billing agent and to improve the Services and the Supplier's other products and services.
