Performance Improvement Plan. 1. If, in the opinion of the Authority, the Contractor is not delivering any aspect of the Services or the Contract as required under the Contract, then the Authority may require the Contractor to, following notice from the Authority at any time during the term of the Contract, work with the Authority to both agree and implement a Performance Improvement Plan. 2. The Authority will prepare the initial version of each Performance Improvement Plan, which shall be in a format determined by the Authority as being appropriate to the nature of the concerns being raised. The Performance Improvement Plan will document the concerns of the Authority and reference the part(s) of the Contract the Authority considers that the Contractor is not delivering against satisfactorily.
