Common use of Performance of Agreement Clause in Contracts

Performance of Agreement. All covenants, conditions and other obligations under this Agreement which are to be performed or complied with by Seller, shall have been fully performed and complied with in all material respects on or prior to the Closing including, without limitation, the deliver of the fully executed instruments and documents in accordance with Section 6.2.

Performance of Agreement. All covenants, conditions and other obligations under this Agreement which are to be performed or complied with by Seller, Seller and the Stockholders shall have been fully performed and complied with in all material respects on at or prior to the Closing includingClosing, without limitation, including the deliver delivery of the fully executed instruments and documents in accordance with Section 6.25.2.

Performance of Agreement. All covenants, conditions and other obligations under this Agreement which are to be performed or complied with by Seller, Buyer and Acquisition Corp. shall have been fully performed and complied with in all material respects on or prior to the Closing including, without limitation, Date including the deliver of delivery and the fully executed instruments and documents in accordance with Section 6.26.3.

Performance of Agreement.
