Performance of Design Obligations. (a) In the design and engineering of the Project, Project Co, its consultants and the Project Co Parties shall, at a minimum, exercise the standard of care normally exercised by licensed or registered professional architectural and engineering personnel having specialized knowledge and experience in performing design activities of a similar nature, scope and complexity.
(b) Project Co shall ensure that all parts of the Works shall, as required by Applicable Law, be performed or reviewed by licensed or registered professional engineers and architects registered to practice in the Province of Ontario. Such architects and engineers shall certify and, if required by Applicable Law, sign and seal, all designs, drawings and technical reports confirming that they comply with all prevailing design standards and design practices for such work in the Province of Ontario, all other applicable standards, Output Specifications and codes, and as otherwise required by Applicable Law.

Such architects and engineers shall certify and, if required by Applicable Law, sign and seal, all designs, drawings and technical reports confirming that they comply with all prevailing design standards and design practices for such work in the Province of Ontario, all other applicable standards, Output Specifications and codes, and as otherwise required by Applicable Law.
(c) Project Co shall ensure that the Design Team certifies that the design and construction of the Expansion Infrastructure is in accordance with the requirements of this Project Agreement as contemplated pursuant to Appendix A of Schedule 10 - Review Procedure. During construction and commissioning of the Expansion Infrastructure, the Design Team shall review Shop Drawings, inspect the Works and review the reports, test results, certificates, confirmations, opinions and inspections prepared by other persons in connection with or relating to the construction and commissioning of the Expansion Infrastructure, all to the extent necessary to satisfy the Design Team that the Works have been performed in compliance with this Project Agreement.
(d) Project Co shall ensure that the Design Team has, and has assigned, sufficient resources necessary to satisfy the construction monitoring activities and frequency of certification required by the Design Team as contemplated pursuant to Schedule 10 - Review Procedure.

(b) Project Co shall ensure that all parts of the Design and Construction Works shall, as required by Applicable Law, be performed or reviewed by licensed or registered professional engineers and architects registered to practice in the Province of Ontario. Such architects and engineers shall certify and, if required by Applicable Law, sign and seal, all designs, drawings and technical reports confirming that they comply with all prevailing design standards and design practices for such work in the Province of Ontario, all other applicable standards, specifications and codes, and as otherwise required by Applicable Law.

(a) In the design and engineering of the Bypass, Project Co, its consultants and the Project Co Parties shall, at a minimum, exercise the standard of care normally exercised by licensed or registered professional engineering personnel and other licensed or registered professionals, as applicable, having specialized knowledge and experience in performing design activities of a similar nature, scope and complexity.
(b) Project Co shall ensure that all parts of the Works shall, as required by Applicable Law, be performed or reviewed by Professional Engineers registered to practice in the Province of Saskatchewan. Such Professional Engineers shall certify and, if required by Applicable Law, sign and seal, all designs, drawings and technical reports confirming that they comply with all prevailing design standards and design practices for such work in the Province of Saskatchewan, all other applicable standards, specifications and codes, and as otherwise required by Applicable Law.
Performance of Design Obligations. (a) In the design and engineering of the Sites, Project Co, its consultants and the Project Co Parties shall, at a minimum, exercise the standard of care normally exercised by licensed or registered architectural, engineering or other professional personnel having specialized knowledge and experience in performing design activities of a similar nature, scope and complexity.
(b) Project Co shall ensure that all parts of the Works shall, as required by Applicable Law, be performed or reviewed by licensed or registered architects, engineers or other professionals, registered to practice in the Province of Ontario. Such architects and engineers shall certify and, if required by Applicable Law, sign and seal, all designs, drawings and technical reports confirming that they comply with all prevailing design standards and design practices for such work in the Province of Ontario, all other applicable standards, specifications and codes, and as otherwise required by Applicable Law.
(c) Without limiting any of the other provisions of this Section 17, Project Co shall, at its sole cost and expense, prepare and provide to the Province, Site Concept Drawings for each Site at least 6 months prior to commencement of the Initial Works on such Site or within a reasonable time prior to the commencement of the Initial Works on Sites with a Targeted Turnover Date on or before the Closing Date.
Performance of Design Obligations.
13.7.1 In the design and engineering of the Project, the Participants and their consultants shall, at a minimum (and without limiting any other obligation under the Agreement), exercise the standard of care normally exercised by licensed or registered professional architectural and engineering personnel having specialized knowledge and experience in performing design activities of a similar nature, scope and complexity. WORKS PHASE
