Common use of Performance of Remaining Work Clause in Contracts

Performance of Remaining Work. The work remaining after a workforce reduction shall 35 be performed by currently employed nurses until the Employer determines that recall 36 shall be initiated. The Employer may employ laid off Nurses who retain recall rights 37 as On-call Nurses to perform available work.

Performance of Remaining Work. The Employer may employ laid off Nurses who retain recall rights 37 as On-call Nurses Neither temporary 20 nurses nor contracted nurses shall be utilized to perform available workbargaining unit work as 21 long as nurses qualified for and interested in such work remain on layoff status.

The work remaining after a workforce 15 work force reduction shall 35 be performed by currently employed nurses until the Employer 16 Medical Center determines that recall 36 shall be initiated. The Employer may employ laid off Nurses who retain recall rights 37 as On-call Nurses Neither temporary 17 nurses nor contracted nurses shall be utilized to perform available workbargaining unit work as 18 long as nurses qualified for and interested in such work remain on layoff status.

The work remaining after a workforce 25 reduction shall 35 be performed by currently employed nurses until the Employer Hospital determines 26 that recall 36 shall be initiated. The Employer Hospital may employ laid off Nurses who retain recall 27 rights 37 as On-call Call Nurses to perform available work, and such laid off nurses who have 28 indicated their availability to perform this work will be offered it before the work is offered 29 to temporary, Resource Pool or contracted nurses. The foregoing section shall not apply 30 to laid-off nurses who do not retain recall rights.

The Employer may employ laid off Nurses who retain recall rights 37 as On-call Nurses Neither 26 temporary nurses nor contracted nurses shall be utilized to perform available 28 interested in such work remain on layoff status. Nor shall per diem 29 nurses be utilized to perform work on a regularly scheduled basis that 30 could be performed by a nurse on layoff status who is qualified for and 31 interested in being recalled for such work.. 32

The Employer may employ laid off Nurses who retain recall rights 37 as On-call Nurses Neither temporary 11 nurses nor contracted nurses shall be utilized to perform available bargaining unit work as 12 long as nurses qualified for and interested in such work remain on layoff status. 13 Nor shall per diem nurses be utilized to perform work on a regularly scheduled 14 basis that could be performed by a nurse on layoff status who is qualified for and 15 interested in being recalled for such work.

The Employer may employ laid off Nurses who retain recall rights 37 as On-call Nurses Neither temporary nurses nor 16 contracted nurses shall be utilized to perform available bargaining unit work as long as 17 nurses qualified for and interested in such work remain on layoff status. Nor 18 shall per diem nurses or LPN’s be utilized to perform work on a regularly 19 scheduled basis that could be performed by a nurse on layoff status who is 20 qualified for and interested in being recalled for such work.
