Common use of Performance Related Fees and Credits Clause in Contracts

Performance Related Fees and Credits. Excess Mileage Fees and Availability Credits shall be paid or credited annually; and Time of Use shall be paid or credited monthly. Provider will invoice Customer for all Excess Mileage Fees, Time of Use Fees, and Availability Credits at least annually following the Contract Year as to which such fees or credits accrue; however, in Provider’s discretion, Provider alternatively may invoice Customer for Time of Use Fees on a monthly, quarterly, or annual basis instead. The amount of the Time of Use Fees and the Excess Mileage Fees will increase by the Annual Escalator as of the first day of each Contract Year after the first Contract Year.
