PERMISSION TO CONNECT. Network Rail grants the Adjacent Facility Owner permission to connect, or, in the case of an existing connection, permission to retain the connection of, the Adjacent Facility to the NR Network.
5.1.1 The Adjacent Facility Owner shall not:
(a) sever the connection of the NR Network to the Adjacent Facility; or
(b) take any action or omit to take any action which impedes access to/from the NR Network at the Connection Point, unless it has, except in an Emergency, given prior notice of such severance, action or omission to Network Rail.
5.1.2 In an Emergency, the Adjacent Facility Owner shall, within a reasonable time of the occurrence of the Emergency, give notice to Network Rail:
(a) of the circumstances giving rise to the Emergency;
(b) the action taken by the Adjacent Facility Owner to deal with the Emergency;
(c) the impact of its actions on the Connection Point; and
(d) an indication of when it will be able to accept rolling stock off the NR Network to the Adjacent Facility.
5.1.3 The Adjacent Facility Owner shall:
(a) [ensure that any part of the Adjacent Facility which is Directly Connected to the NR Network is compatible with the NR Network and complies with applicable Railway Group Standards;] [If no part is Directly connected, replace this clause with: 5.1.3

(b) be responsible for the Operational Control of all rolling stock movements on the Adjacent Facility;
(c) ensure that:
(i) the operation of the Adjacent Facility; and
(ii) any person authorised by the Adjacent Facility Owner to be at or on the Premises, does not cause any disruption to the NR Network;
(d) promptly provide Network Rail with any amendments to the Adjacent Facility Owner’s safety and security requirements, as listed in Schedule 4, in relation to the Premises and the Adjacent Facility; and
(e) establish and maintain adequate security at the Premises.
PERMISSION TO CONNECT. The parties agree that this Agreement acknowledges a request for water and wastewater service from the CITY. This Agreement further provides terms herein which constitute the response to the DEVELOPER’S request for water and sewer service and the availability of such service. This Agreement constitutes a formal commitment from the CITY to DEVELOPER to reserve capacity for the Property pursuant to the terms of this Agreement. The CITY shall accept the facilities so long as they are built in accordance with the provisions of this Agreement and certified at the DEVELOPER’S expense by a professional engineer licensed by the State of Florida to have been built substantially in accordance with the approved plans. The DEVELOPER, or any owner of any parcel of the Property, or any occupant of any residences or buildings located thereon shall not have the right to and shall not connect any customer installation to the water and wastewater facilities of the CITY until approval for such connection has been granted by the CITY.
PERMISSION TO CONNECT. 4.1 Network Rail grants AKIL permission to connect the Core Valley Lines Network to the NR Network at the Queen Street Connection Point.
4.2 AKIL grants Network Rail permission to connect the NR Network to the Core Valley Lines Network at the Queen Street Connection Point.
5.1 Obligations of AKIL
5.1.1 AKIL shall not:
(a) sever the connection of the NR Network to the Core Valley Lines Network at the Queen Street Connection Point; or
(b) take any action or omit to take any action at or in the vicinity of the Queen Street Connection Point which impedes and/or interferes with access to/from the Core Valley Lines Network at or around the Queen Street Connection Point, unless it has, except in an Emergency, obtained the prior written consent of Network Rail (whose consent shall not be unreasonably withheld) in respect of such severance, interference, impediment, action or omission and, where applicable, acted in accordance with any Applicable Procedures in relation to the undertaking of any inspection, maintenance, repair or renewal of the Core Valley Lines Network.
5.1.2 In an Emergency, AKIL shall, within a reasonable time of the occurrence of the Emergency and in accordance with any Applicable Procedures, give notice to Network Rail:
(a) of the circumstances giving rise to the Emergency;
(b) describing the action taken by AKIL to deal with the Emergency;
(c) describing the impact of its actions on the Queen Street Connection Point; and
(d) giving an indication of the timescale for reinstating the connection and allowing rolling stock access to the NR Network.
5.1.3 AKIL shall:
(a) reinstate, at its own cost, the connection of the Core Valley Lines Network to the NR Network, where such connection has been severed by AKIL:
(i) as soon as reasonably practicable after the date of severance; and
(ii) in accordance with applicable Railway Group Standards;
(b) consult with Network Rail in respect of all planned inspections, maintenance, renewals or enhancements on the Core Valley Lines Network which may impede access to and/or from the NR Network in accordance with any Applicable Procedures, and have due regard to any comments and representations reasonably made by Network Rail in relation thereto;
(c) be responsible for the Operational Control of all rolling stock movements on the Core Valley Lines Network except to the extent that the parties have agreed in the CVL Services Agreement that Network Rail shall be responsible for such Operational Control;

PERMISSION TO CONNECT. 4.1. The Customer hereby permits MetaLINK to remotely or directly access and connect to the Customer's computer systems and network for the express purpose of providing Service. The Customer will cooperate in good faith to enable such connections to occur.

The CITY shall accept said facilities so long as they are built in accordance with the provisions of this Agreement and certified at DEVELOPER’S expense by a professional engineer licensed by the State of Florida to have been built substantially in accordance with the approved plans. DEVELOPER, or any owner of any parcel of the Property, or any occupant of any residences or buildings located thereon shall not have the right to and shall not connect any customer installation to the water and wastewater facilities of the CITY until approval for such connection has been granted by the CITY.

5.1.1 The Adjacent Facility Owner shall not:
(a) sever the connection of the DB Cargo Network to the Adjacent Facility; or
(b) take any action or omit to take any action which impedes access to/from the DB Cargo Network at the Connection Point, unless it has, except in an Emergency, given prior notice of such severance, action or omission to DB Cargo.
5.1.2 In an Emergency, the Adjacent Facility Owner shall, within a reasonable time of the occurrence of the Emergency, give notice to DB Cargo:
(a) of the circumstances giving rise to the Emergency;
(b) the action taken by the Adjacent Facility Owner to deal with the Emergency;
(c) the impact of its actions on the Connection Point; and
(d) an indication of when it will be able to accept rolling stock off the DB Cargo Network to the Adjacent Facility.
5.1.3 The Adjacent Facility Owner shall:
(a) ensure that any part of the Adjacent Facility which is Directly Connected to the DB Cargo Network is compatible with the DB Cargo Network and complies with applicable Railway Group Standards;
(b) be responsible for the Operational Control of all rolling stock movements on the Adjacent Facility;
(c) ensure that:
(i) the operation of the Adjacent Facility; and
(ii) any person authorised by the Adjacent Facility Owner to be at or on the Premises, does not cause any disruption to the DB Cargo Network;
(d) promptly provide DB Cargo with any amendments to the Adjacent Facility Owner’s safety and security requirements, as listed in Schedule 4, in relation to the Premises and the Adjacent Facility; and
(e) establish and maintain adequate security at the Premises.
PERMISSION TO CONNECT. 4.1. The Customer shall procure the permission for ONS to remotely or directly access and connect to the Client’s computer systems and network for the express purpose of providing the Service. The parties will cooperate in good faith to enable such connections to occur.
