Nothing contained herein will in any way restrict or impair any party's right to use, disclose or otherwise deal with any Confidential Information which: (a) at the time of disclosure is properly in the public domain or thereafter becomes part of the public domain by publication or otherwise through no breach of this Agreement by the party receiving such information;
