Common use of POLLUTION EXCLUSION Clause in Contracts

POLLUTION EXCLUSION. Both parties acknowledge that HEB’s scope of services does not include any services related to the presence of any hazardous or toxic materials. In the event HEB or any other party encounters any hazardous or toxic materials, or should it become known to HEB that such materials may be present on or about the jobsite that may affect the performance of HEB’s services, HEB may, at its option and without liability for consequences or any other damages, suspend performance of the services under this agreement until the City has abated the materials and the jobsite is in full compliance with all applicable laws and regulations.
