Common use of Prevailing Wage Clause in Contracts

Prevailing Wage. a. Contractor and subcontractors shall comply with all provisions required by ORS 279C.800 through ORS 279C.870 relating to the payment of prevailing wage rates for work performed. b. Contractor and subcontractors shall pay to workers in each trade or occupation the current, applicable State prevailing rate of wage as established by the Oregon State Bureau of Labor and Industries (“BOLI”) ▇▇▇▇://▇▇▇.▇▇▇▇.▇▇▇▇▇.▇▇.▇▇/BOLI Contractor and any Subcontractors shall post the prevailing wage rates and fringe benefits as required by ORS 279C.840. c. If the Contractor has not filed the certified statements as required under this contract, the City of Bend shall retain 25 percent of any amount earned by the Contractor until the Contractor has complied. The City of Bend shall pay the Contractor the amount retained under this subsection within 14 days after the Contractor has filed the certified statements with the City. d. Contractor shall allow BOLI to enter the office or business establishment of Contractor at any reasonable time to determine whether the prevailing rate of wage is actually being paid and shall make payment records available to BOLI on request. Contractor shall require subcontractors to provide the same right of entry and inspection. e. City shall not make final payment unless the prevailing wage rate certifications are received. f. Contractor and any Subcontractor shall use forms approved by the City for certified payroll reporting and submit all required reports weekly.

Prevailing Wage. a. Contractor and subcontractors The wages to be paid for a day's work to all classes of laborers, workmen, or mechanics on the work contemplated by this contract, shall comply with all provisions required by ORS 279C.800 through ORS 279C.870 relating to be not less than the payment of prevailing wage rates rate for a day’s work performed. b. Contractor and subcontractors shall pay to workers in each the same trade or occupation in the currentlocality within the state where the work hereby contemplates to be performed as determined by the Director of Industrial Relations pursuant to the Director’s authority under Labor Code Section 1770 et seq. Each laborer, applicable State worker or mechanic employed by a Contractor or by any subcontractor shall receive the wages herein provided for. The Contractor shall pay forty dollars ($40) per day penalty for each worker paid less than prevailing rate of wage as established by per diem wages unless the Oregon State Bureau failure of Labor and Industries (“BOLI”) ▇▇▇▇://▇▇▇.▇▇▇▇.▇▇▇▇▇.▇▇.▇▇/BOLI Contractor and any Subcontractors shall post the prevailing wage rates and fringe benefits as required by ORS 279C.840. c. Contractor and subcontractors shall prepare weekly certified payroll reports and statements and submit them to the City by the fifth business day of each month (ORS 279C.845). Reports shall be submitted to the City of Bend, Attention: Purchasing Manager, on a form prescribed by the Commissioner of the Bureau of Labor, certifying: (a) the hourly rate of wage paid each worker whom the contractor or subcontractor to pay the Subcontractor has employed upon correct rate of per diem wages was a good faith mistake and, if so, the public works; error was promptly and voluntarily corrected when brought to the attention of the contractor or subcontractor. The penalty may not be less than eighty dollars (b$80) that no for each calendar day, or portion thereof, for each worker employed upon the public works has been paid less than the prevailing rate of wage rate, if the contractor or subcontractor has been assessed penalties within the previous three years for failing to meet its prevailing wage obligations on a separate contract, unless those penalties were subsequently withdrawn or overturned. The penalty may not be less than one hundred twenty dollars ($120) for each calendar day, or portion thereof, for each worker paid less than the minimum hourly prevailing wage rate, if the Labor Commissioner determines that the violation was willful, as defined in subdivision (c) of Section 1777.1. The difference between the prevailing rate of per diem wages and the wage specified paid to each worker shall be paid by the Contractor to each worker. The City will not recognize any claim for additional compensation because of the payment by the Contractor for any wage rate in excess of prevailing wage rate set forth in the contract. The possibility of wage increases is one of the elements to be considered by the Contractor in determining the Contractor’s bid, and will not, under any circumstances be considered as the basis of a claim against the City on the contract. a. Posting of Schedule of Prevailing Wage Rates and Deductions. If the schedule of prevailing wage rates is not attached hereto pursuant to Labor Code Section 1773.2, the Contractor has not filed shall post at appropriate conspicuous points at the certified statements as required site of the project a schedule showing all determined prevailing wage rates for the various classes of laborers and mechanics to be engaged in work on the project under this contractcontract and all deductions, the City of Bend shall retain 25 percent of any amount if any, required by law to be made from unpaid wages actually earned by the Contractor until the Contractor has complied. The City of Bend shall pay the Contractor the amount retained under this subsection within 14 days after the Contractor has filed the certified statements with the Citylaborers and mechanics so engaged. d. Contractor shall allow BOLI to enter the office or business establishment of Contractor at any reasonable time to determine whether the prevailing rate of wage is actually being paid and shall make payment records available to BOLI on request. Contractor shall require subcontractors to provide the same right of entry and inspection. e. City shall not make final payment unless the prevailing wage rate certifications are received. f. Contractor and subcontractors must comply with all laws and regulations relating to prevailing wages, whether or not set out in this contract.
