Common use of Process and Obligations Clause in Contracts

Process and Obligations. On termination or expiration of the Master Agreement, Client may wish to instruct K2 to delete or return all Client Personal Data (including copies) from K2's systems in accordance with applicable Data Protection Law. K2 will, after a recovery period of up to thirty (30) days following expiry or termination of the Master Agreement, comply with this instruction as soon as reasonably practicable, where technically feasible. Client shall be responsible for retrieving any remaining Client Personal Data it wishes to retain before the end of the recovery period. K2 shall not be required to delete or return Client Personal Data to the extent that K2 is required by applicable law or order of a governmental or regulatory body to retain some or all of the Client Personal Data or such Client Personal Data is required for K2 to enforce or defend its legal rights or interests. In addition, except to the extent required by applicable law, K2 shall not be required to delete or return Client Personal Data archived on back- up systems if K2 shall securely isolate it and protect it from any further Processing and such Client Personal Data is deleted in accordance with K2’s standard overwriting and deletion policies.
