Return or Destruction of Data. On the earlier of (a) Client’s written request or (b) termination or expiration of this DPA or the Services Agreement, Nectar HR will destroy or return to Client, at its election, all Personal Data in its possession or control; provided, however, this Section shall not apply to the extent that Nectar HR is required by any applicable Data Protection Law or other law to retain some or all of the Personal Data.
