Project and Budget Clause Samples

The "Project and Budget" clause defines the scope of work to be performed and establishes the financial parameters for the project. It typically outlines the specific tasks, deliverables, and milestones expected, as well as the total budget, payment schedule, and any limitations on costs or expenses. By clearly delineating both the work to be done and the associated financial commitments, this clause ensures that both parties have a mutual understanding of expectations and helps prevent disputes over scope or payment during the course of the project.
Project and Budget. The Grantee agrees to use the Grant to provide funds for that portion of the Project not being paid from other sources as set forth in the budget for the Project attached hereto as Exhibit B (the “Project Budget”). No portion of the Grant shall be used for any purpose whatsoever other than the Project without the prior written approval of the Executive Director of the Commission (the “Executive Director”). No material changes shall be made in the scope of the Project or to the Project Budget without the prior written approval of the Executive Director. Any document signed by the Executive Director accepting a change in the scope of the Project or to the Project Budget shall specifically set forth the accepted change. If the maximum authorized amount of the Grant exceeds the amount necessary to complete the Project, the excess shall not be disbursed to the Grantee but shall remain with the Commission. If excess funds were disbursed, such excess funds shall be returned to the Commission within thirty (30) days of the earlier of the completion of the Project or the expiration of this Agreement. The Grantee agrees to cause the Project to be acquired, constructed, improved, equipped, furnished and/or otherwise undertaken as described in Exhibit A and will cause the Project to be completed on or before the expiration of this Agreement. The Grantee affirms that the Grant funds and funds available from the other sources specified in the Project Budget will be sufficient to cause the Project to be completed. The Grantee agrees to comply with all applicable federal, state, and local laws and regulations pertaining to the Project and the use and application of Grant funds.
Project and Budget. The Grantee will complete all actions described in Exhibit A and the Application (the “Project”), both of which are hereby incorporated by reference. In connection with the Project, the Grantee shall meet or exceed the deliverables described in Exhibit A (the “Project Outputs”). In the event the description of the Project or Project Outputs in the Application and Exhibit A conflict, Exhibit A will control. The Grantee agrees to complete the Project within three years of the Award Date (the “Grant Period”). The Grant Period may be extended as provided in the Funding Policies (as defined herein). The Grantee represents that the Grant funds and funds available from the other sources specified in the Project Budget (as defined herein) will be sufficient to cause the Project to be completed and agrees that the Commission makes no actual or implied promise to fund the Project except as provided herein.
Project and Budget. The Project shall provide for the retrofit of identified streets or roads on the RECIPIENT’s approved work plan. In accordance with applicable laws and ordinances, the RECIPIENT agrees to enter into an agreement with an independent contractor and/or material providers, or otherwise provide for the Project work plan to be completed by the RECIPIENT’s own forces. The RECIPIENT further agrees that it shall be solely responsible for and shall pay its independent contractor and/or material providers. If RECIPIENT uses its own forces, it shall be solely responsible for paying the costs thereof. Under no circumstances shall the TIB be responsible to any third party for the payment of labor or materials used in completing the Project work plan. The Project work plan may be amended by the Parties, pursuant to Section 7.
