Project Commencement. For purposes of the Project Commencement Milestone, Project Commencement shall mean that Landlord has closed on all equity and debt financing necessary for the construction of the Landlord’s Work and site work has commenced.

If a project is not operational within 90 days of the original start date of the award period or grant award date as noted on this memorandum, whichever is later, the grantee must submit a statement to OOG explaining the implementation delay. Upon receipt of the 90-day letter, OOG may cancel the project and redistribute the funds to other project areas. OOG may also, where extenuating circumstances warrant, extend the implementation date of the project past the 90-day period.

If work on the Project is not commenced within sixty (60) days of the date of this Agreement, Grantee must submit a second letter explaining the additional delay in implementation. Grantor may, after reviewing the circumstances, consider Grantee in default in accordance with Section 4(c) and may terminate the Agreement in accordance with Section 4(b).
Project Commencement. The term of this Agreement shall remain in effect provided Developer has applied for site plan approval for any component of the Project within five (5) years of this Agreement being executed and Developer has applied for a building permit for any part of the Project within three (3) years of the Township's approval of the site plan for the first development component. The timeframes within this Section may be extended by the Township Board, at the Board's discretion. Notwithstanding the foregoing, this Agreement shall not create or impose any obligation on Developer to build, open, operate, or continuously operate, a business or any particular business on the Property.
