Project Execution Plan. Without prejudice to any other provision of this Attachment A or the Agreement which sets out specific requirements for any of the plans or documents listed below, within sixty (60) Days after Notice to Proceed, Contractor shall submit to Owner for review Contractor’s project execution plan (“Project Execution Plan”), which shall address, summarize, and provide a schedule for development and finalization of the following plans, procedures, and other documents: a. Project Execution Plan. (i) Northwind shall develop a project execution plan (the "Project Plan") that shall be comprised of a Plant Schedule and estimated Plant testing and Start-up dates. The Project Plan, which shall be based on the Plant Scope, shall include a definition of the construction work, major milestones, Critical Path Activities, and scheduled date of completion and shall state that the Plant is scheduled to commence operation no later than the Final Completion Deadline. (a) The Plant Schedule shall identify as Critical Path Activities those key milestones to be achieved in order to achieve Substantial Completion on or before the Substantial Completion Deadline. The Plant Schedule also shall indicate the proposed dates of starting and completion of the Work, including dates for fabrication, assembly, installation, testing and completion of the Critical Path Activities and other major components of the Work. In preparing the Plant Schedule and in order to complete the Work within the time required by this Agreement, Northwind will take into consideration and make allowance for customary delays and hindrances incident to such Work in accordance with generally accepted construction management practices, whether growing out of delays of common carriers, delays in securing materials or workmen, delays in Northwind securing necessary approvals, Northwind delays or otherwise (excluding delays for which an extension of time is allowable under Section 11). Northwind, in consultation with Aladdin, shall update the Plant Schedule to reflect changes necessitated by Sections 9 and/or 11 hereof. (ii) An initial draft of the Project Plan shall be delivered by Northwind to Aladdin for Aladdin's review no later than thirty (30) days after receipt by Northwind from Aladdin of a Notice to Proceed. Aladdin agrees to provide any comments regarding the Project Plan to Northwind within ten (10) days of receipt thereof. Aladdin's failure to comment in writing within such period shall be deemed to constitute Aladdin's acceptance of the Project Plan. Review, comment or acceptance (or the lack thereof) by Aladdin shall not in any way affect or reduce Northwind's obligations to complete the Work in accordance with the terms of this Agreement. Northwind agrees to consider in good faith any and all comments made by Aladdin. Within ten (10) days of receipt of comments from Aladdin, Northwind and Aladdin shall meet at a mutually acceptable time and place to discuss Aladdin's comments. If Northwind...
Project Execution Plan. DOE shall have received, on or prior to the Effective Date, the execution plan on which the Project is based, which shall contain the following, in a form and substance satisfactory to DOE (unless set forth otherwise below): (i) the contents described in Exhibit MM (Form of Project Execution Plan) in sufficient detail, as determined by DOE, in consultation with the Independent Engineer; (A) a Primavera P6 Level 3 (or other level of detail as agreed in writing by DOE in consultation with the Independent Engineer) schedule for the development, permitting, detailed engineering design, procurement, and construction of the Project, consisting of a construction time-plan, an equipment availability and integration schedule and payment milestones with regards to development, construction, achieving Engineering and Design Completion, Mechanical Completion and Commissioning Completion of the Project (including delivery dates for various technical documents and procedures as indicated in the Technical Document Schedule until the Project Completion Date and detailed schedule (including projected execution date and applicable contractor) for the execution and delivery of each Construction Contract (other than those existing on the date hereof)), (B) a list of milestone activities corresponding to each of the milestone dates for Performance Testing, Substantial Completion, Start of Production, Reliability Test, Final Completion and Project Completion, and (C) other items, in each case, as set forth in Exhibit W (Project Milestones) (such schedule, list and other items, as may be modified (other than with respect to the Project Completion Longstop Date) from time to time as provided hereunder, the “Project Milestone Schedule”), in scheduled chronological order, that the Borrower will need to satisfy in order to fully complete the Project, together with the anticipated completion dates for each of the Project Milestones and the anticipated costs and expenses that the Borrower expects will be incurred in connection with, and upon the completion of, each of the Project Milestones, in form and substance satisfactory to DOE and the Independent Engineer; (iii) a detailed description of scope, design, specifications and warranties of the work to be performed pursuant to each Construction Contract (other than those existing as of the date hereof); (iv) a detailed description of the overall financing plan (the “Financing Plan”) for the Project, including all sources and uses of f...

Project Execution Plan. As a condition precedent to Owner’s obligation to pay Contractor’s first Application for Payment following the Effective Date, Contractor must submit its detailed “Project Execution Plan” for performing its Work at the Site.
Project Execution Plan. 11.1. Following the signing of this Contract (ARO) a kick-off meeting will be held on Site in order for the Parties to define and finalize technical and administrative issues necessary for the commencement of the Works, as further detailed in section 7.3.5.4 of the Technical Specifications (the "Kick-Off Meeting"). 11.2. As part of the Kick-Off Meeting the Supplier shall perform the Official and Final Site Survey, and shall perform any additional necessary inspections on site. Failure by the Supplier to perform the Site Survey, or any part thereof, shall not derogate from the Supplier's responsibility for the completion of the Project in full and in time in accordance with the provisions of the Contract.

Project Execution Plan. Turnkey Contractor’s Project Execution Plan will be maintained throughout the term of this Agreement that provides the guidelines by which the Work will be performed and delivered. The Project Execution Plan shall contain, among other materials, an organisational chart, correspondence procedures, a Work filing system, procedures for the review of the Design Documents and project progress and verification procedures to be implemented for use by the MEP Participants.
Project Execution Plan. DOE shall have received, on or prior to the Effective Date, the execution plan on which the Project is based, which shall contain the following, in a form and substance satisfactory to DOE (unless set forth otherwise below): (i) with respect to Block 1, the contents described in Exhibit G (Form of Project Execution Plan) in sufficient detail, as determined by DOE, in consultation with the Independent Engineer; (ii) a Primavera P6 Level 1 (or other level of detail as agreed in writing by DOE in consultation with the Independent Engineer) schedule for the development and construction of Block 1, consisting of a construction time-plan and an equipment availability and integration schedule with respect to the development and construction of Block 1, in scheduled chronological order, that the Borrower will need to satisfy in order to fully complete Block 1, as such schedule as may be modified from time to time as provided hereunder, in form and substance satisfactory to DOE and the Independent Engineer (as such schedule may be updated from time to time in accordance with the terms hereof, the “Block 1 Construction Schedule”), with anticipated completion dates; (iii) a detailed description of the overall financing plan (the “Block 1 Financing Plan”) for Block 1, including all sources and uses of funding associated with Block 1 (including specific line items for each material component, phase or element of Block 1), proposed Advances and the Borrower Funding Commitment (including how such amounts are allocated to each specific line item referenced above); (iv) a detailed estimate of the Project Costs, together with a description of the methodology and assumptions used to produce such estimate; and (v) the Block 1 Project Milestone Schedule (the items in (i) through (v) above, as may be updated from time to time in accordance herewith, being referred to herein collectively as the “Block 1 Project Execution Plan”).
