Common use of Proportion of Salary Clause in Contracts

Proportion of Salary. a. A teacher upon appointment shall be paid as from the date upon which the teacher commenced duty, provided that a teacher who has taught (or has been granted leave by the school) for each day of the school year at the particular school shall be paid as for a full calendar year commencing. A teacher who ceases duty before completing 10 teaching weeks of employment shall be paid in lieu of vacation pay an amount equal to 1/12th of their ordinary pay for the period of employment. b. A teacher who ceases duty after at least 10 teaching weeks of employment shall be paid the proportion of the teacher's annual salary of that year that the teacher's service excluding school vacations bears to a standard school year: Provided that such proportion of salary shall be calculated on the salary which the employee was receiving immediately before cessation of employment. c. For the purposes of this clause, in any employing authority, a standard school year for a teacher is calculated as: Number of weeks in Term 1 + Number of weeks in Term 2 + Number of weeks in Term 3 + Number of weeks in Term 4 = One standard year.
