Provisions to be Applied in a Uniform and Nondiscriminatory Manner Clause Samples

This clause requires that all terms and conditions within the agreement are enforced consistently and without bias among all parties or affected individuals. In practice, it means that no party receives preferential treatment or is unfairly disadvantaged by the application of the contract’s provisions; for example, rules regarding access, fees, or obligations must be the same for everyone in similar circumstances. The core function of this clause is to promote fairness and prevent arbitrary or discriminatory enforcement, thereby ensuring equal treatment and reducing the risk of disputes over inconsistent application.
Provisions to be Applied in a Uniform and Nondiscriminatory Manner. In deciding whether or not to grant any request for a loan hereunder, the Committee shall be guided by procedure and criteria designed to assure that uniformity is applied to all Participants and Beneficiaries under similar circumstances and that the granting of such approval does not result in discrimination prohibited by the Code.
