Public Access and Use. If Grant Recipient’s project includes any capital improvements, Grant Recipient agrees to maintain or ensure continued public access to such improvements.
Public Access and Use. Contractor agrees to allow the public access to and use of the Rec Area at times and for lawful purposes (not including hunting) pursuant to the River District’s established fee schedule and approved hours and dates of operation. The schedules of currently approved fees and dates and hours of operation are attached as Exhibit B. To facilitate public use of the Rec Area, all existing roads shall remain open to the public, except for roads as may be closed by joint agreement of the Contractor and the authorized River District representative, or by the authorized River District representative if necessary for the safe operation and maintenance of ▇▇▇▇▇▇▇ Mountain Reservoir.
Public Access and Use. Public access shall be maintained on the Public Access Components during the Hours of Operation subject to the Events provisions outlined herein. The public shall have the right to use the Public Access Components for any lawful purpose during the Hours of Operation except that such use may not be disruptive to the on‐going operations of the hotel, restaurants, other businesses or Events associated with, or held at, the Project. Furthermore, the Public Access Components shall be operated and maintained in an orderly manner that is consistent with the standards of operation for the Hotel property on the Site. The public is specifically granted the right to bring food and beverages for their own consumption to the Public Access Components subject to the provisions of the Management Agreement. The transport and consumption of food and beverages shall be limited to reasonable personal use. Notwithstanding the foregoing, the use of grills, steamers, coolers, vending equipment or similar apparatus are specifically restricted on the Public Access Components. In no event shall the public be allowed to bring alcoholic beverages to the Site. Furthermore, the Public Access Components on the Hotel Site shall be designated as non‐smoking areas.

  • Public Access Grantor acknowledges and agrees that the general public shall have the regular and substantial opportunity to view the Façade from the streets, sidewalks and other property near the Buildings. Grantor shall have no obligation under this Agreement to allow the general public to view the interior of the Buildings.

  • Access and Use Grantee agrees to license or otherwise make available to MassCEC in perpetuity, without charge, ▇▇▇▇▇▇▇’s interest in and copyright (if any) to all non-confidential materials prepared and produced in relation to the Project, including, without limitation, all plans, specifications, and analyses developed in connection with the Project and specified as being for MassCEC’s use and public dissemination; provided, however, that any and all inventions that are conceived or first reduced to use during the course of the Project shall be the sole property of Grantee (except that if jointly invented, title shall flow in accordance with United States patent law), and any licensing requests for such inventions shall be subject to good faith negotiations between the Parties. Grantee represents and warrants that Deliverables will not infringe on any copyright, right of privacy, or personal or proprietary rights of others.
