Common use of Public Right-of-Way Clause in Contracts

Public Right-of-Way. For the purpose of operating and maintaining a cable television system in the City, Franchisee may erect, in, over, under, or upon, across, and along the public right of way within the City such wires, cables, fiber optics, conductors, ducts, conduits, vaults, manholes, amplifiers, appliances, pedestals, attachments, and other equipment as are necessary and appurtenant to the operation of the cable television system in the City and in accordance with this Franchise Agreement and the Cable Ordinance.

For the purpose of operating and maintaining a cable television system in the CityTown, Franchisee may erect, in, over, under, or upon, across, and along the public right of way within the City Town such wires, cables, fiber optics, conductors, ducts, conduits, vaults, manholes, amplifiers, appliances, pedestals, attachments, and other equipment as are necessary and appurtenant to the operation of the cable television system in the City Town and in accordance with this Franchise Agreement and the Cable Ordinance.
