Qualified Financial Contract Clause Samples

A Qualified Financial Contract (QFC) clause defines certain financial agreements that are subject to special legal treatment, typically to ensure their enforceability in the event of insolvency or bankruptcy. This clause applies to contracts such as derivatives, repurchase agreements, and securities lending arrangements, which are often used by financial institutions to manage risk and liquidity. By clearly identifying which contracts are considered QFCs, the clause helps ensure that these agreements can be terminated or netted out quickly, thereby reducing systemic risk and providing certainty to counterparties during financial distress.
