Common use of Quality of Performance Clause in Contracts

Quality of Performance. At any time during the term of the Agreement, if the Director determines the Agency is not performing the Work in a manner likely to achieve the outcomes and indicators established in the Agreement, the Director and District senior administration will meet to develop a plan for corrective action with a timeline to address identified concerns in Work performance. Failure to follow the terms of the corrective action plan shall constitute a material breach of the Agreement and cause for termination in the City’s discretion as described in Section 550 of the General Terms and Conditions.
