REACH / RoHS. The Seller hereby represents, warrants and certifies that the Goods (including their components, parts and materials) are fully compliant with any applicable rules and regulations on the restriction of hazardous substances, including, without limitation, Directive 2002/95/EC, as such may be amended from time to time, and any regulations, rules, releases, decisions or orders relating thereto adopted by any applicable government agency (collectively, “RoHS”). In particular, Seller shall, at the Company’s request, furnish to the Company a declaration of RoHS compliance for any Good supplied hereunder. The Seller hereby represents, warrants and certifies that the Goods (including their components, parts and materials) are fully compliant with the requirements of Regulation (EC) No. 1907/2006 (Registration Evaluation and Authorization of Chemicals), as such may be amended from time to time, and any regulations, rules, releases, decisions or orders relating thereto adopted by any applicable government agency (collectively, “REACH”). In particular, Seller will meet its disclosure obligations under Article 33 of REACH by informing the Company of any Good containing a Substance of Very High Concern (SVHC) over 0.1% by weight, and shall provide the Company with sufficient information to allow safe use of any such Good, including, without limitation, the provision of a comprehensive material safety data sheet.
REACH / RoHS. The REACH Regulation EC 1907/2006 (Registration, Evaluation, Authorization and Restriction of Chemicals) and Directive 2011/65 / EU (RoHS 2 - Restriction of Hazardous Substances) serves to protect human health and the environment from hazardous chemicals. The Supplier is responsible for ensuring that the requirements of REACH and Directive 2011/65 / EU are respected. The conformity is to be proved to the Customer in a written form whenever necessary or at regular intervals (2-year cycle). REACH / RoHS. The Seller will comply with all applicable export and re-export control laws including, without limitation, laws related to export licensing, in connection with performing its obligations hereunder. The Seller will provide the Company with the Export Control Classification Number, or such similar number from other jurisdictions, and any other foreign trade data with respect to the Goods and their components, and any changes to such data, as the Company may reasonably request. The Seller represents and warrants that it and its employees, agents and representatives have not violated and will not violate any provision of any applicable anti-bribery or anti-corruption laws. If the Seller fails to meet its obligations in this paragraph, Seller shall defend, indemnify and hold the Company harmless from and against any fines, penalties and/or damages resulting there from. In addition, the Company may, at its discretion, terminate this order without any further liability or obligation.

  • Bilingual Pay Where the Employer currently pays bilingual pay or bonuses, it shall continue to do so. The Employer retains discretion to initiate bilingual pay or bonuses. The minimum bilingual bonus or hourly equivalent is $25 per pay period. The Employer may not require an employee to use bilingual skills without paying the appropriate bonus or pay. This does not apply to employees where such skills are in the classification specification.
