Reasonable Steps to Mitigate. Except for Third Party Claims for which the Indemnifying Party assumes control of the negotiation settlement or defence pursuant to section 8.10, the Indemnified Party will take commercially reasonable steps to mitigate all Losses, including availing itself of any defences, limitations, rights of contribution, claims against third persons, and other rights at law or equity and will provide such evidence and documentation of the nature and extent of the Loss as may be reasonably requested by the Indemnifying Party and in determining the amount of any Loss, reasonable mitigation will be taken into account. 9.1 Termination
