Reasonable Steps to Mitigate. The Indemnified Party will take commercially reasonable steps to mitigate all Damages, including, including availing itself of any defences, limitations, rights of contribution, claims against third persons, and other rights at law or equity and will provide such evidence and documentation of the nature and extent of the Damages as may be reasonably requested by the Indemnifying Party and in determining the amount of any Damages, reasonable mitigation will be taken into account.
