RECOGNITION AND NEGOTIATIONS. 4.01 The Employer recognizes the Canadian Union of Public Employees and its Local 5050 as the sole and exclusive bargaining agent for all of its Employees, save and except the Directors of Finance, Human Resources, Operations and Programs and Student Services; Coordinator of Finance, Coordinator(s) of Human Resources, Race Relations/Cross-Cultural Understanding/ Human Rights, Transportation; Facilities Management, Communications Officer, Data Manager/Web Master, Operations Managers, Purchasing Agent, Buyer, three Accountants, Secretary to Superintendent, Secretary to Director of Operations; Secretary to Director of Programs and Student Services, Secretary to Director of Finance, three Secretaries to Human Resources Department, Office Manager, Supervisors of Payroll and Accounts Payable, Board Network Administrator, Employee Benefits/Occupational Health and Safety Officer, NSTU employees, and those employees excluded by Section 1(a), Subsections 2(a & b) of the Nova Scotia Trade Union Act. 4.02 No Employee shall be required or permitted to make any written or verbal agreement, which may conflict with the terms of this contract. 4.03 This Agreement applies to: (1) Regular Full-time Employees; (2) Regular Part-time Employees; (3) Probationary Employees from the date of hire, except as otherwise provided for in this agreement; and (4) Casual Employees as restricted by Article 4.04 herein. 4.04 The following terms, conditions and benefits of this Collective Agreement shall apply to Casual Employees as at the date of signing: (1) they shall become members of the bargaining unit on their date of hire with restricted rights and privileges as defined herein. (2) they shall be subject to call for work at the discretion of the Employer and may be disciplined, terminated or dismissed with or without cause at any time. (3) they shall be paid 85% of the rate of any given classification as provided in Schedule "A". (4) they shall receive vacation pay at the rate of 4% to be paid with each pay received from the Employer; (5) they shall be entitled to the following bereavement leave provided the Casual Employee has worked the fifteen (15) consecutive working days immediately before and further provided that such leave is taken immediately upon the death and/or the funeral: (i) for death of the Casual Employee's spouse, child, step-child, parent or step- parent, brother and sister, a leave of three (3) working days with pay shall be granted; (ii) for death of the Casual Employee's mother-in-law, father-in-law, brother-in- law, sister-in-law, son-in-law, daughter-in-law, legal dependent, grandparent and grandchild, a leave of one (1) working day with pay shall be granted; (6) they shall be entitled to holidays in accordance with the Labour Standards Code and in addition, the following holidays or pay in lieu thereof, provided the employee has worked the fifteen (15) consecutive working days immediately before and the regularly scheduled working day immediately after the following holidays: New Year's Day Canada Day Remembrance Day Good Friday 1st Monday in August Christmas Day Easter Monday Labour Day Victoria Day Thanksgiving Day (7) Subject to seniority provisions within the Agreement which are only applicable to all regular full-time and regular part-time employees, casual employees whose names are on the Employer’s casual list of a particular classification within the bargaining unit and who apply shall be given preference to positions which become available within their individual classification, having regard to their length of service which shall be determined by their first day worked as a casual employee in that classification. This provision shall be pursuant to the job posting and hiring provisions and the filling of temporary leaves that are known by the Employer to exceed ninety (90) days. (8) They shall only be entitled to grieve the matters contained in this Article 4.04(3),(4),(5)(i) and (ii) and 6 and 7.

A temporary employee shall not continue beyond a period of six (6) continuous months, except in the following circumstances: (a) with the written mutual consent of the employer, the following holidays or pay in lieu thereof, provided the employee has worked the fifteen (15) consecutive working days immediately before and the regularly scheduled working day immediately after union president (b) to cover the full extent of any pregnancy and/or parental leave (c) to cover for employees on the first 30 months of disability and for employees transferred under article 10.06. 2.05 A temporary employee shall pay union dues in accordance with article 3 of this agreement and shall not be covered by the following holidays: New Year's Day Canada Day Remembrance Day Good Friday 1st Monday articles:- schedules B and D and pension provisions not otherwise required by law. No temporary employee shall have the right to grieve with respect to discharge or lay-off nor shall such employee have bumping rights. 2.06 If a temporary employee is continued in August Christmas Day Easter Monday Labour Day Victoria Day Thanksgiving Dayemployment as a permanent employee; the time served continuously in temporary employment shall be counted as part of their probationary service/seniority. (7) Subject 2.07 The wage rate for temporary employees will be as per Schedule A of this agreement. 2.08 Any vacancies will be offered to seniority provisions within the Agreement which are only applicable to all regular full-time and regular part-time current qualified permanent employees, casual and if not filled in this manner, offered to qualified temporary employees whose names are currently on the EmployerTemporary Employees Service List with the organization, before the Employer may hire from outside. 2.09 On commencing employment or within a reasonable time thereafter, the employee’s casual list of a particular classification within immediate supervisor shall introduce the bargaining unit and who apply shall be given preference to positions which become available within their individual classification, having regard to their length of service which shall be determined by their first day worked as a casual new employee in that classification. (a) Persons whose jobs are not in the bargaining unit shall not work on any jobs which are included in the bargaining unit, Supervisors except in cases mutually agreed up on by the Parties. It is mutually agreed that the ▇▇▇▇▇▇▇ shall not be on the “on-call” overtime list and that their general function is to supervise. The ▇▇▇▇▇▇▇ shall be permitted to do the work of Payroll and Accounts Payable, Board Network Administrator, Employee Benefits/Occupational Health and Safety Officer, NSTU employees, and those the unit during normal working hours. The ▇▇▇▇▇▇▇ shall not do the work of the unit while there are available employees excluded by Section 1(a), Subsections 2(a & on lay-offs able to do the work. The ▇▇▇▇▇▇▇ shall not work overtime unless it is to complete work in progress which members of the unit who have been working on the work in progress do not want to work overtime to complete after a request is made of such employee. (b) The term “Students” shall be understood to be those persons regularly attending high school, college or university on a full time basis. It is expressly understood that only those Articles or sub Articles which specifically refer to “Students” will apply to the “Students”. (c) A Part Time employee is an employee who is regularly scheduled no more than 24 hours per week and not scheduled more than 1248 hours per annum. 3.03 The Employer acknowledges that the right of the Nova Scotia Trade Union Actto appoint or otherwise select up to three (3) Stewards who shall comprise both the Grievance and Bargaining Committees. The Union will notify the Employer of the names of the Bargaining Committee. 4.02 3.04 The Union acknowledges that the ▇▇▇▇▇▇▇ has regular duties to perform on behalf of the Employer. In a situation which requires a ▇▇▇▇▇▇▇’▇ attention during working hours, they shall not leave their regular duties without first obtaining permission to do so from their immediate supervisor. (4) they shall receive vacation pay at the rate of 4% to be paid with each pay received from the Employer; (5) they shall be entitled to the following bereavement leave provided the Casual Employee has worked the fifteen (15) consecutive working days immediately before and further provided that such leave is taken immediately upon the death and/or the funeral: (i) for death of the Casual Employee's spouse, child, step-child, parent or step- parent, brother and sister, a leave of three (3) working days with pay shall be granted; (ii) for death of the Casual Employee's mother-in-law, father-in-law, brother-in- law, sister-in-law, son-in-law, daughter-in-law, legal dependent, grandparent and grandchild, a leave of one (1) working day with pay shall be granted; (6) they shall be entitled to holidays in accordance with the Labour Standards Code and in addition, the following holidays or pay in lieu thereof, provided the employee has worked the fifteen (15) consecutive working days immediately before and the regularly scheduled working day immediately after the following holidays: New Year's Day Canada Day Remembrance Day Good Friday 1st Monday in August Christmas Day Easter Monday Labour Day Victoria Day Thanksgiving Day (7) Subject to seniority provisions within the Agreement which are only applicable to all regular full-time and regular part-time employees, casual employees whose names are on the Employer’s casual list of a particular classification within the bargaining unit and who apply shall be given preference to positions which become available within their individual classification, having regard to their length of service which shall be determined by their first day worked as a casual employee in that classification. RECOGNITION AND NEGOTIATIONS. 4.01 3.01 The Employer Pembina Trails School Division, or anyone authorized to act on its behalf, approves and recognizes the The Canadian Union of Public Employees and its Employees, Local 5050 4588-01, chartered by The Canadian Union of Public Employees, as the sole and exclusive collective bargaining agent for its Employees classified and covered by this Agreement and hereby consents and agrees to negotiate with the Union or any authorized committee thereof, in any and all of its matters affecting the relationship 3.02 between the two parties to this Agreement, looking toward a peaceful and amicable settlement ofany differences that may arise between them. (a) Except as herein after provided, the Board will deduct Union dues, only from Regular and Temporary Employees, whether or not an Employee is a member of the Union, on a monthly basis, the amount of regular monthly membership dues payable by a member of the Union.
