RECOGNITION AND SCOPE OF REPRESENTATION. The District confirms its recognition of CSEA as the exclusive representative of 6 classified employees as set forth in Board Resolution #4 dated July 7, 1976, and 7 acknowledges that CSEA is the exclusive bargaining representative for all 8 classified employees, except employees classified as: 10 Management 11 Supervisory 12 Confidential Employees 13 Short Term* 14 Substitute* "Substitute employee," as used in this section, means any person employed to replace any classified employee who is temporarily absent from duty. "Short-term employee," as defined in California Education Code, Section 45103. 15 *Education Code #45103 states in part:
RECOGNITION AND SCOPE OF REPRESENTATION. 1.1 The District recognizes the Federation as the exclusive representative for all classified employees holding those positions listed in Appendix A. 1.1. Newly created classified positions that are not management, confidential or supervisory shall be added to Appendix A upon mutual agreement of the parties. If the parties do not agree whether a newly created classified position is management, confidential or supervisory, the matter shall be submitted to the Public Employment Relations Board for resolution. 1.2. All matters not specifically enumerated in this Agreement are reserved to the District, except as defined in this contract. Nothing herein shall be construed to limit the right of the District to consult with any employees or the Federation on any matter outside the scope of representation.

RECOGNITION AND SCOPE OF REPRESENTATION. The Superintendent recognizes the California School Employees Association (hereinafter CSEA) as the exclusive representative for those employees in the classified unit. The classified unit consists of those non- certificated employees assigned a permanent or probationary status rendering service in positions within the classified service of the San Benito County Office of Education (SBCOE) not designated as supervisory, management or confidential. The Superintendent and CSEA recognize the right of employees to form, join, as well as participate in lawful activities of employee organizations. There shall be no unlawful discrimination as a result of the exercise of the rights set forth in this Article. All matters not specifically enumerated in this Agreement are reserved to the Superintendent. Nothing herein shall be construed to limit the right of the Superintendent to consult with any employee or CSEA on any matter outside the scope of representation.

  • Scope of Representation The scope of representation shall be limited to matters relating to wages, hours of employment and other terms and conditions of employment as defined under the Education Employment Relations Act.

  • Restatement of Representations and Warranties The Borrower hereby restates and renews each and every representation and warranty heretofore made by it in the Credit Agreement and the other Loan Documents as fully as if made on the date hereof, except to the extent that any representation or warranty related to an earlier specified date, and with specific reference to this Amendment and all other loan documents executed and/or delivered in connection herewith.

  • Accuracy of Representations All of Buyer’s representations and warranties in this Agreement (considered collectively), and each of these representations and warranties (considered individually), must have been accurate in all material respects as of the date of this Agreement and must be accurate in all material respects as of the Closing Date as if made on the Closing Date.
