RECOGNITION AND UNION BUSINESS. 3.1 The Employer recognizes the Union as the exclusive bargaining agent for all Employees employed in the bargaining unit as defined by the certificate issued by the Labour Relations Board, and any amendments thereto. 3.2 An Employee shall not engage in Union business during their business hours without prior permission of the Employer. 3.3 A duly accredited officer employed by the Union may be permitted on the Employer’s premises for the purpose of transacting Union business provided prior permission to do so has been granted by the Employer. 3.4 The name of a Local Unit Representative or ▇▇▇▇▇▇▇ shall be supplied in writing to the Employer before they are recognized as the Local Unit Representative or ▇▇▇▇▇▇▇. The Local Unit Representative or ▇▇▇▇▇▇▇ shall be entitled to leave work to carry out their functions as provided in this Collective Agreement, provided permission to leave work during working hours, and agreement on the length of time of such leave, shall first be obtained from the supervisor. Local Unit Representatives and Stewards shall suffer no loss of pay for time spent on the Employer’s premises in performing their duties. 3.5 The Employer shall allow the Union to have access to bulletin boards in each facility for the posting of information related to the employment relationship and other Union business. 3.6 Except as otherwise specified elsewhere in this Collective Agreement, all correspondence between the parties arising out of this Collective Agreement or incidental thereto shall pass to and from the Human Resources Representative, or designate of the Employer and the Union. 3.7 No Employee shall be required or permitted to make any written or verbal agreement which is in direct conflict with the terms of this Collective Agreement. 3.8 A representative of the Union shall have the right to make a presentation of up to thirty (30) minutes paid time during the probationary period of new Employees with respect to the structure of the Union as well as the rights, responsibilities, and benefits under the Collective Agreement, provided, however, that attendance at the presentation shall not be compulsory and, further, that a representative of the Employer may be present at such presentation. The scheduling of such presentation shall be agreed upon between the Employer and the Union. Presentations shall be held no more than once per month, as necessary. The Union representative making the presentation shall be the Local Unit Representative or ▇▇▇▇▇▇▇ from the site at which the presentation is being held or the Union Labour Relations Officer.

The Employer Township hereby recognizes the Union Superior Officers Association as the exclusive bargaining collective negotiations agent for all Employees employed in the bargaining unit as defined by the certificate issued by the Labour Relations BoardSergeants, Lieutenants, and any amendments theretoCaptains. 3.2 An Employee B. C. The Township shall permit members of the Association Negotiating Committee to attend mutually scheduled collective bargaining meetings during working hours without loss of pay and the Township shall also permit members of the Association Negotiating Committee upon at least 24 hours notice to the Police Chief, Deputy Chief or designee to attend unilateral meetings with its attorney or an official designated representative during duty hours without loss of pay. The Association shall upon request of the Township submit to it the names of those persons serving in the Association Negotiating Committee, such committee not to exceed three (3) persons. D. Representatives of the Association shall be permitted to transact official Association business on Township property at all reasonable times, provided that it shall not interfere with or interrupt normal Township operations. E. In accordance with basic practice, the length of Township shall grant the President or the person acting as his legal representative such reasonable time of such leave, as is necessary to conduct his responsibilities to the Superior Officers Association and there shall first be obtained from the supervisor. Local Unit Representatives and Stewards shall suffer no loss of pay for if such reasonable time is required to be spent on the Employer’s premises in performing their dutiesduring his regular tour or work week, except as set forth below. 3.5 F. The President of the Superior Officers Association or his designee shall be excused from his work assignment, without loss of pay or compensation from the Township, and shall be granted a reasonable amount of time to handle Superior Officers Association/Management business, provided however, that prior to the need of such release time for Superior Officers Association/Management business, the President or his designee shall notify his immediate supervisor or, in his absence, the Chief of Police. G. The Employer shall allow permit the Union Grievance Committee to have access conduct the business of the Committee which consists of conferring with the employees and management on specific grievances in accordance with the grievance procedure set forth herein during the duty hours of the members without the loss of pay, providing the members of the Grievance Committee give prior notice to either their supervisors or the Chief of Police, and providing that the conduct of said business shall not diminish the effectiveness of the Police Department nor require overtime to maintain the effectiveness of the Police Department. H. The Township will provide space on a bulletin boards board in each facility a conspicuous location in Police Headquarters for the use of the Superior Officers Association for posting of information related notices concerning Superior Officers Association business and activities. I. Any employee covered by this agreement not wishing to belong to the employment relationship Manalapan Township Superior Officers Association shall have deducted from his wages the sum equal to eighty-five percent (85%) of the Association dues and other Union business. 3.6 Except as otherwise specified elsewhere which sum shall be remitted monthly to the Association directly by the Township Treasurer. Such payment shall represent a legal deduction for each affected officer’s wages.
