Common use of Recurring Disability Clause in Contracts

Recurring Disability. Successive periods of Total Disability or Residual Disability due to the same or related cause will be considered one period of Total Disability or Residual Disability unless separated by the Member’s return to Active Status for a continuous period of at least 10 consecutive working days. Such period of Active Status within a period of Total Disability or Residual Disability shall not be counted as part of the Maximum Benefit Period. Return to work, as part of an approved rehabilitative program will not be considered a return to Active Status.
