Redevelopment Project Clause Samples
The Redevelopment Project clause defines the terms and conditions under which a property may undergo significant renovation, reconstruction, or repurposing. Redevelopment Project. The Consultant will provide administration of this Project Agreement as described in the Contract Documents during construction until issuance of the final certificate for payment, and subject to Section 8.1 and with STEGH’s concurrence, from time to time until the completion of any correction of defects as provided in Article 36.
Redevelopment Project. Shall include, but not be limited to, the “Fairpark District” project as described in the TIF Plans, which includes two or three multi-story mixed use office, retail, and/or upper floor housing buildings which are a total of approximately 40,000 square feet each located within the TIF District all as defined in the TIF Documents.
Redevelopment Project found by Project Co in the Contract Documents during its review. If Project Co does discover any Design Issue in the Contract Documents, Project Co shall not proceed with the Work affected until Project Co has first complied with the provisions of Section 11.18. Project Co acknowledges that it is responsible for the risks assumed by Project Co in Sections 11.17 and 11.18 and that any additional costs resulting from such risks will form part of the Project Co Design Contingency. It is intended that the review of the Contract Documents conducted by Project Co pursuant to this Section 5.2(a) be carried out by Project Co and the Project Co Parties using their own experiences and expertise in accordance with the standard of care set out in Section 11.2(a)(viii) and in accordance with the representations and warranties of Project Co set out in Section 7.1.
Redevelopment Project. Key Personnel
Redevelopment Project. Project Co shall coordinate the installation of all Equipment in accordance with this Section 13 and provide periodic reports thereon to the Equipment Subcommittee.
Redevelopment Project obligation to provide for all standard Building Code requirements applicable to the installation of the Work, whether or not set out in the Specifications; and/or
Redevelopment Project exercise the same standard of due care and diligence as set out in Section 11.2(a)(viii) in respect of any Products, personnel, or procedures which it may recommend to STEGH;
Redevelopment Project. The licence provided in this Section 9.1 with respect to the Site shall automatically terminate on the Final Completion Date or upon the earlier termination of this Project Agreement in accordance with its terms.
Redevelopment Project provide for the coordination and scheduling of the activities and work of STEGH’s other contractors and STEGH’s own forces with the Work to be performed under this Project Agreement;
Redevelopment Project. (a) The overall development of the Project Area will include the Redevelopment Project to be constructed by the Redeveloper. The Redeveloper shall construct the Redevelopment Project on the Project Area under the terms of the Agreement, and in accordance with the Redevelopment Plan and the Governmental Approvals, and within the Redevelopment Project Schedule established herein. The Redeveloper shall construct the Project Area Site Improvements in accordance with the Governmental Approvals.
(b) The Agency’s designation of the Redeveloper as the redeveloper of the Project Area is premised upon the Agency’s desire to ensure that the Redevelopment Project is Completed by the Redeveloper.
(c) Notwithstanding any provision in the Agreement that may be construed to the contrary, the following are conditions precedent to the Redeveloper being obligated to construct the Redevelopment Project:
(i) The Redeveloper shall have acquired title to the Property;
(ii) The Township enters into an agreement with the Redeveloper providing for the transfer to the Redeveloper of title to the Adjacent Parcel in accordance with Section 4.01(c); provided, however, that this condition may be satisfied by the Township’s counter-execution of this Agreement with respect to such Section 4.01(c);
(iii) The Redeveloper shall have acquired title to the Adjacent Parcel;
(iv) The Parties have executed a Financial Agreement for the Redevelopment Project in accordance with Section 3.05 and on terms acceptable to the Redeveloper;
(v) The Redeveloper shall have secured an agreement with the Department of the Navy, and the approval of the NJDEP, for the removing and/or relocating of buildings and/or structures that are part of the engineering controls of the approved plan for the site remediation of the Property;
(vi) Obtained all Governmental Approvals for the Redevelopment Project.
(d) Notwithstanding any provision in this Agreement that may be construed to the contrary, Redeveloper shall have the right to determine, in its sole discretion, the purchase price, rental rates and terms of the Redevelopment Project.
(e) Notwithstanding any provision in this Agreement that may be construed to the contrary, the Redeveloper agrees that it will incorporate a landscape plan into the site plan that will be presented to the Planning Board for the Redevelopment Project, which landscape plan shall contain a variety of ornamental trees, shrubs and plants, as well as foundation plantings and street trees alon...
