REDUCTION IN STAFF. A. No new teachers 15.1 During the term of this Agreement, the Committee shall be hired in subject areas before teachers who are laid off from other subject areas who may be highly qualified and meet effectiveness ratings established in the administrative guidelines, are recalled or decline the opening. 15.2 If the Committee determines that reductions in staff are necessary or warranted because of a decrease in the number of pupils or for any other reason, the following standards and procedure will be applied:
(a) The Committee shall effectuate said reductions in the following order:
(i) Those teachers, if any, whom the Committee can demonstrate have performed in a less than satisfactory manner for two (2) consecutive school years, including the year in which the reduction in force is to take place, shall be laid off first;
(ii) Should further reductions in force be necessary, they shall be performed in inverse order of seniority.
(b) Teachers whom the Committee has designated to be laid off pursuant to the provisions of Section 15.2(a)(i) above shall be given notice of said designation on June 1st of the school year in which they are to be laid off.
(a) Seniority shall be defined as a person’s total length of continuous service measured in years and days from the date of last hire in the Dedham Public Schools. The Continuous service during an entire school year shall be treated as one year regardless of the number of actual teacher days in that school year. Service during a portion of the school year shall be measured in teacher days provided that the accumulation of one hundred (180) teacher days shall be counted as one year for purposes of this article. Said continuous service shall include time spent on paid leaves of absence, but shall not include time spent on unpaid leaves of absence. However, unpaid leaves of absence shall not be deemed to break seniority from date of last hire. A teacher employed on a regular part-time basis shall receive seniority credit during any period of part-time employment pro-rated according to the teacher’s regular schedule. For example, a teacher regularly employed for one (1) continuous year on a one-half (1/2) time basis, shall receive one-half (1/2) year’s seniority.
(b) Termination shall not be deemed a break in seniority. A teacher returning from a layoff will only occur through a complete year or seniority break shall be credited with all of her/his previously accumulated seniority. For the purpose of layoff in the event that employees have equal seniority, as herein before defined, the teacher has attained the highest level of education recognized on the teacher salary schedule shall be considered senior. When determining seniority in accord with the highest level of education recognized on the salary schedule, the date used will be February 1 following timely posting of the seniority list. REDUCTION IN STAFF. A. No new The Board of Education will establish the educational curriculum and staffing requirements. Prior to making a reduction in staff, the Board of Education agrees to discuss the matter with the Association.
B. Seniority shall be defined as length of service as a teacher within the ▇▇▇▇▇▇▇ School District.
1. Seniority begins on the employee's first working day.
2. Teachers shall be placed on the seniority list by an impartial drawing separating everyone with the same starting date.
3. The seniority list shall be published and posted conspicuously in all buildings of the District by October 15th of each school year. Revisions and updates of the seniority list shall also be published and posted at the beginning of the second semester.
4. Seniority shall be broken for the following reasons:
a. If the employee quits
b. If the employee is legally discharged.
c. If the employee retires
d. If the employee is absent for three (3) consecutive working days without properly notifying the employer. (This includes return from sick leave and leaves of absence.)
e. If the employee gives a false reason for a requested leave of absence excluding personal leave days.
5. The seniority of part-time teachers shall be hired in subject areas before accrue at the same rate as full-time teachers.
C. In the event it becomes necessary to reduce the number of teachers who are laid off from other subject areas who may be highly qualified and meet effectiveness ratings established in the administrative guidelinesneeded, are recalled or decline the opening. In the event that two or more teachers are, in the judgment of the Committee, deemed to be substantially equal on the basis of evaluation, the recommendation of the Superintendent, professional training, and experience within a discipline during the continuous years of service in the ▇▇▇▇▇▇ Public Schools, the least senior of such teachers shall be laid off first.
4. Continuous employment in the ▇▇▇▇▇▇ Public Schools, including periods of leaves of absence for which salary credit is granted, shall be used to compute the length of service.

REDUCTION IN STAFF. The provisions of this Article 7:8 shall apply only on occasions when the total number of permanent positions in a designated area is reduced. On those occasions when there is such a reduction in the total number of permanent positions, the following procedures will be used:
A. No new Staff reductions will first be accomplished through attrition of staff.
B. Teachers who are not on a continuing contract with the District will be terminated prior to teachers who are on a continuing contract with the District.
C. In special layoff situations due instances where a more senior teacher is significantly less qualified solely because of the teacher's experience and training related to the remaining available positions in the designated area, the District shall make a discontinuation of a particular program offeringgood faith effort to reassign teachers in said designated area being reduced in accordance with the teacher's qualifications so that the senior teachers may be retained. In reassigning teachers in order to insure, or to allow for maximum reemployment whereby certification is limited to an individual teacher onlyas much as possible, that a junior teacher(s) does not displace a senior teacher(s) the District shall reassign teachers in such a manner that if it is necessary for the junior teacher(s) to displace a senior teacher(s), as much as possible, the more senior teacher(s) is retained. If after such reassignments the junior teacher(s) is still significantly more qualified than a senior teacher, the senior teacher may be laid off individually to avoid a major disruption first. Qualifications shall be determined by experience and training related to the overall education program. Prior to the slotting meeting, the Board will provide the Association with a list of remaining available positions for the coming year. Teachers who are placed on layoff status because of a necessary reduction in personnel shall be notified sixty (60) calendar days prior to the end of the school year. At other times, teachers shall receive twenty (20) school days' notice, or in lieu of said notice, they shall receive twenty (20) days' pay. See Letter of Agreement #15.
B. Recall to vacancies shall be based on seniority in reverse order of layoffs according to the slotting procedures contained in the document entitled Slotting Procedures for L'Anse Creuse Public Schools. At the request of either party, said procedure will be reviewed and necessary changes may be made by the mutual agreement of both parties.
C. Teachers are encouraged to be cognizant of the employment and educational trends relative to their skills. It is realized that up to fifteen (15) calendar days prior to the end of the current school year, in order to allow for maximum reemployment of laid- off teachers for the upcoming school year, involuntary assignments or transfers of non- released teachers may be necessarydesignated area.
D. In the event of a decision by the Board of Education to close a school or schools, the following procedure Part-time teachers shall be utilized:placed in a pool for the purpose of layoffs in part-time positions. The same procedure as that contained in Section C above shall be followed.
1E. Title I teachers shall be placed in a pool for the purpose of layoffs in Title I positions. By May 10The same procedure as that contained in Section C above shall be followed.
F. Should a teacher who has seniority in more than one designated area be laid off in a given designated area, that teacher shall be considered in the pool of teachers in the buildings alternate designated area(s) for the purpose of reduction in staff under the same provisions as contained in Article 7:8C.
G. A teacher employed in a position that does not require a specific certification area or designated area in Appendix H, will be considered to be closed will displace the least senior teachers in the school district according to seniority and designated area in which the teacher holds certification by building and/or department in the master schedule for the following school year(last taught). The teachers from the closed buildings teacher will select their new assignments with the most senior teacher making the first selection. This procedure must be implemented prior to the beginning accrue seniority in both his/her current position and in his/her area of the slotting procedure.
2. If these teachers cannot displace any other teachers according to #1 above, then they are to be considered displaced and will be assigned according to the approved slotting procedure.
E. In the event of a decision by the Board of Education to consolidate two schools into one school or to consolidate programs, the following procedure shall be utilized:
1. By May 10, the teachers in the buildings to be consolidated will select their assignments from the consolidated building’s master schedule with the most senior teacher making the first selection. This procedure must be implemented prior to the beginning of the slotting procedure.
2. If these teachers cannot make a selection according to #1 above, then they are to be considered displaced and will be assigned according to the approved slotting procedure.
3. By March 1 the teachers in the programs to be consolidated will select their assignments from the consolidated program schedule with the most senior teacher, including tie breaker number, making the first selection. This procedure must be implemented prior to the development of the building schedules.
4. If these teachers cannot make a selection according to #3 above then they are to be considered part of their assigned (current) building staff and will be placed on that master schedule according to their certification.
