Common use of Reduction of Personnel Clause in Contracts

Reduction of Personnel. A. When the Board determines that a reduction in the number of regular drivers is necessary, the affected drivers shall be added to the top of the seniority list of relief drivers in order of seniority. A “reduction” within this meaning does not refer to any type of reduction of hours within or among runs and/or routes within or among the attendance areas. Increases and decreases of driving times may occur from time to time as enrollment demographics, attendance boundaries, etc., change. Such changes in hours shall not result in recall rights to a particular run, route, or attendance area. B. Should a layoff occur, employees will be laid off in the following order: 1. Relief drivers 2. Probationary regular drivers 3. Regular drivers in reverse order of seniority The driver(s) to be laid off will be notified at least ten (10) calendar days prior to the effective date of the layoff. C. If the district decides to eliminate a route, the affected driver may bump using his or her district seniority. The driver does not go to the bottom of the seniority list, but may use his/her district seniority to displace a less senior driver with equivalent or fewer hours. D. If a shuttle or transfer is eliminated during the school year, the affected driver shall bump the least senior driver with a shuttle or transfer that fits into the reduced driver’s schedule. E. When a recall of laid off or underemployed (more than one hour per day) driver(s) is required, preference will be given to the driver(s) by recalling in order of greatest District seniority, e.g., the highest District seniority to the lowest. F. Notice of recall shall be sent by certified or registered mail to the last known address as shown on the Employer's records. The recall notice shall state the time and date on which the employee is to report back to work. It shall be the employee's responsibility to keep the Employer notified as to his/her current mailing address. A recalled employee shall be given at least ten (10) calendar days from registered receipt of mailing, excluding Saturdays and Sundays, to report to work. The Employer may fill the position on a temporary basis until the recalled employee can report for work providing the employee reports within the ten (10) day period. Employees recalled to work for which they are qualified are obligated to take said work. An employee who declines recall to perform work for which he/she is qualified shall forfeit his/her seniority rights.

In the event of a reduction in the number of regular drivers is necessarytie, the affected drivers shall order will be added to based upon the top of the seniority list of relief drivers following, in order of seniority. In the event the previous three (3) criteria do not break a tie in reverse order seniority, a drawing will immediately be held to determine an individual ranking. Acting positions will be counted toward an administrator’s sen- iority on the LEADS Reduction Seniority List containing the position in which the administrator is acting, provided that the administrator received recognition of the acting status from the BOARD, or the administrator received an administrative salary (other than only for extra weeks worked). Administrators on special assignment will continue to accrue seniority in the po- sition they held on the LEADS Reduction Seniority List imme- diately before being placed on special assignment. No seniority is granted for additional weeks worked in the summer (e.g. summer school, special assignments in central office or building assignment). When an administrator is laid off and is working as a teacher, no seniority will be granted as an administrator. If an administrator resigns from the school district and rejoins the school district, his/her seniority begins with the date he/she is rehired. No seniority is granted for time worked in an internship. B. It is the intent of the BOARD to give at least ninety (90) days notice of layoff to the administrator and LEADS. If conditions do not permit such notification, the right of the BOARD to make such necessary reductions is not altered. It is the intent of the parties to meet periodically to discuss staffing. C. Any administrator serving on a temporary basis in the adminis- trative position to be reduced shall be the first to be subject to layoff. D. If further reductions are necessary, then, the lowest seniority employee on the LEADS Reduction Seniority List that contains the position to be reduced shall be displaced, and the remain- ing employees on that list will be assigned to the remaining positions on that LEADS Reduction Seniority List. E. The driver(semployee so displaced, may then bump a less senior em- ployee on another LEADS Reduction Seniority List based upon that displaced employee’s seniority on that list. At the conclusion of this bumping process, on recommendation of the Superintendent, the BOARD will designate the administra- tor(s) to be laid off will be notified at least ten (10) calendar days prior to the effective date of the layoff. C. If the district decides to eliminate a route, the affected driver may bump using his or her district seniority.
